COMPLAINT
Plaintiff, Aurum Ceramic Dental Laboratories, Inc., by
its counsel, David L. Harnish and Meyer, Unkovic & Scott LLP,
hereby files the within Complaint and in support thereof sets
forth the following:
1. Plaintiff, Aurum Ceramic Dental Laboratories,
Inc., is a Washington corporation with a principal office located
at 1320 N. Howard Street, Spokane, Washington, 99201.
2. Defendant, Stephen M. Rydesky, Jr., DDS, is an
adult individual whose business address is 5005 E. Trindle Road,
Mechanicsburg, Cumberland County, pennsylvania 17050.
3. Venue lies in Cumberland County because it is the
location of Defendant's place of business.
4. At the special instance and request of Defendant,
Plaintiff provided and delivered to Defendant certain dental

laboratory services from December of 2003 through February of
2004.
An itemized statement evidencing the balance due is
attached hereto, marked as Exhibit "A," and incorporated by
reference as if fully set forth,herein.
5. The prices set forth in Exhibit ~A" were the fair,
reasonable and market prices prevailing at the times of the
transactions for the dental laboratory services prescribed by and
sold to Defendant, and are the prices which Defendant agreed to
pay.
6. As of December 23, 2004, the balance owed to
Plaintiff by Defendant for the dental laboratory services is
$2,052.74.
7. Although repeatedly requested to do so, Defendant
has failed and/or refused to pay the aforesaid balance, interest
or any part thereof to Plaintiff.
COUNT I - QUANTUM MERUIT
AURUM CERAMIC DENTAL LABORATORIES, INC. v. RYDESKY

Paragraphs 1 through 7 of this Complaint as if set forth at
length herein.
9. Plaintiff provided and delivered to Defendant
certain dental laboratory services having a fair market value of
at least $2,052.74 which remains due and owing.

10. Plaintiff is entitled to recover the fair market
value of the unpaid dental laboratory services it provided to
Defendant.
11. Defendant has, despite repeated demands, failed to
pay plaintiff the full value of the dental laboratory services
provided and delivered to it by Plaintiff.
WHEREFORE,
Plaintiff,
Aurum
Ceramic
Dental
Laboratories, Inc., demands judgment in its favor and against
Defendant, Stephen M. Rydesky, Jr., DDS, in the amount of
$2,052.74, together with legal interest, costs of suit, including
without limitation reasonable attorneys' fees, and such other
relief as the Court deems appropriate.
COUNT II - UNJUST ENRICHMENT
AURUM CERAMIC DENTAL LABORATORIES, INC. v. RYDESKY
12. Plaintiff

Paragraphs 1 through 11 of this Complaint as if set forth at
length herein.
13. As a result of Defendant's failure to remit funds
due and owing, Plaintiff has been deprived of the rightful amount
of not less than $2,052.74 due for the dental laboratory services
the plaintiff provided and delivered to Defendant. Defendant has
been unjustly enriched at Plaintiff's expense.

14. Although repeatedly requested to do so by
Plaintiff, Defendant has willfully failed and refused to pay the
aforesaid balance, interest or any part thereof to Plaintiff.
15. Defendant expects or should have expected to pay
all amounts now sought by Plaintiff, and Plaintiff has a
reasonable expectation of payment.
16. The interests of justice and society's reasonable
expectations of persons and property are defeated by nonpayment,
and Plaintiff demands that it be awarded the relief sought
herein.
WHEREFORE,
Plaintiff,

Dental
Laboratories, Inc., demands judgment in its favor and against
Defendant, Stephen M. Rydesky, Jr., DDS, in the amount of
$2,052.74, together with legal interest, costs of suit, including
