CUM �TIP'ULATION AGAINST LIENS

THIS AGREEMENT made the day of November, 2013, by and between Norm Elam,
hereinafter referred to as Contractor,
AND
Evelyn L. Rebenstorff, hereinafter referred to as Owner, whereby the former undertook and agreed
to erect and construct a building on that certain lot of ground situate in South Middleton Township,
Cumberland County, Pennsylvania and being more commonly known as Lot 1 Jefferson Drive, as
more particularly described in Exhibit "A" attached hereto and incorporated herein by reference.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said Contractor, for
and in consideration of the sum of ($1.00) Dollar to it in hand paid by Owners, the receipt whereof
is hereby acknowledged, and the further consideration mentioned in the agreement aforesaid, for
itself and its subcontractors, and all parties acting through or under them, covenant and agree that no
mechanic's liens or claims shall be filed or maintained by it or any of its subcontractors against the
said buildings and the lot of ground appurtenant thereto for or on account of any work done or
materials furnished by it or any of its subcontractors under said contract or otherwise, for, towards,
in, or about the erection and construction of the said buildings on the lot above described, and the
said Contractor, for itself, its subcontractors and others under them hereby expressly waive and
relinquish the right to have, file, and maintain any mechanic's liens or claims against the said
buildings or any of them, and agree that this instrument, waiving the right of lien, shall be an
independent covenant. L

ALL THAT CERTAIN lot or piece of ground situate in South Middleton Township, Cumberland County,
Pennsylvania, Lot No. 1 on the Final Subdivision Plan of Jefferson Court, recorded in the Office of the Recorder
of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 87, Page 146, the same being numbered as
more particularly described as follows:
BEGINNING at a point on the northern right -of -way line of Woodlawn Lane (a 50 foot wide right of way) on the
dividing line of Lot No. 1, North 05 degrees 53 minutes 32 seconds East, 135.02 feet to a point; thence along
lands, North 89 degrees 00 minutes 12 seconds East, 106.00 feet to a point; thence along the dividing line of Lot
No. 1 and Lot No. 2, South 02 degrees 38 minutes 43 seconds West, 172.37 feet to a point; thence along the
western right -of -way line of Jefferson Drive (a 50 foot wide right of way), by a curve to the right having a radius
of 175.00 feet, an arc length of 15.02 feet with a chord bearing North 86 degrees 33 minutes 57 seconds West,
15.01 feet; thence continuing along the northern right -of -way line of Jefferson Drive (a 50 foot wide right of
way), North 84 degrees 06 minutes 28 seconds West, 75.00 feet to a point; thence continuing along the western
right -of -way line of Jefferson Drive (a 50 foot right of way) by a curve to the right having a radius of 25.00 feet,
an arc length of 39.27 feet with a chord bearing, North 39 degrees 06 minutes 28 seconds West, having a chord
length of 35.36 feet to a point and the place of BEGINNING.
CONTAINING 18,217.693 square feet, more or less.
