I direct the payment of all my just debts and funeral
expenses as soon after my decease as the same can be conveniently

Dollars apiece, to my two (2) grandsons, to wit, TIMOTHY WILBUR
and CJffiISTOPHER WILBUR, and direct that the inheritance tax on

WHEREAS, access to both the Glessner and Wilbur properties from Hempt Road
(L.R. 21018) is over a 25 foot wide tract ofland, and
WHEREAS, Naomi T. Glessner owned a 10 foot wide tract ofland which is a
patt of said 25 foot wide tract extending from Hempt Road to land of Wilbur, and
WHEREAS, Wilbur owns a 15 foot wide tract of land which is part of said 25
foot wide tract, extending from Hempt Road to lands of Glessner, and
WHEREAS, access from Hempt Road to both properties has been over said 25
foot wide tract and has been used by both parties in common for many years but the right
of way has never been documented, and
WHEREAS, Virginia R. Wilbur in her capacity of Executrix of the Last Will and
Testament of Naomi T. Glessner, was disqualified to convey an interest in the estate to
herself and her husband, Harold James Wilbur and by Order of Court dated October 23,
2001, the Clerk of the Orphans' Court division of the Court of Common Pleas was
ordered to convey an easement in favor of Virginia Ruth Wilbur and Harold James
Wilbur for access to Hempt Road.
WITNESSETH, that pursuant to Order of Court and in consideration of good and
valuable consideration passing from grantees to the Naomi T. Glessner Estate, the grantor
does by these presents grant and convey to the grantees, their heirs, and assigns, a non
exculsive easement for ingress, egress, and regress for persons and vehicles to and from
Hempt Road over land of Naomi T. Glessner, deceased situate in Silver Springs
Township bOWlded and described as follows:
BEGINNING at a point in Hempt Road (L.R. 21018) at the northwest comer of
land of the grantees; thence by Hempt Road, north 01 degree 30 minutes west, 10 feet to
a point at land of Janet Glessner; thence by lands of Janet Glessner and through lands of
Naomi T. Glessner, deceased, north 88 degrees 30 minutes east 416.5 feet to a point;
thence by lands of the grantees, south 01 degree 30 minutes east, 10 feet to a point;
thence by land of the grantee and land now or formerly ofH. R. Sherrard, south 88
degrees 30 minutes west 416.5 feet to a point the place of BEGINNING
Being part of the same premises conveyed to W. Leroy Glessner and Naomi T.
Glessner by deed dated November 6,1957, recorded in Deed Book D, Volume 18, page
248 and all the premises conveyed thereto by deed dated December 12, 1957, recorded in
Deed Book E, Volume 18, Page 249. W. Leroy Glessner died July 5, 1984, whereupon
title vested in Naomi T. Glessner by operation oflaw. She died December 23, 2000, and
Letter Testementaty on her estate was granted to Virginia R. Wilbur.

PETITION
To the Honorable, the Judges of said Court:
The petition of Virginia R. Wilbur, also known as Virginia Ruth Wilbur, by John M.
Eakin, her attorney, respectfully represents:
1.) Your petitioner is the executrix of the Last Will and Testament of Naomi T.
Glessner who died December 23, 2000, letters testamentary were granted to her on January
5,2001.
2.) Naomi T. Glessner owned real estate in Silver Spring Township at the time of
her death conveyed to her and W. Leroy Glessner, her husband who predeceased her, by
deed dated November 6, 1957, recorded in Deed Book D, Volume 18 at Page 248.
3.) The home of your petitioner and her husband, Harold James Wilbur, is erected
on an adjoining tract of land. Their deed is dated March 6, 1974 and is recorded in Deed
Book N, Volume 25 at Page 281.
4.) The only access to both the Wilbur and the Glessner tract from the public road
(L.R.21015 known as Hempt Road) is over a 10 foot wide right of way the centerline of
which is the dividing line between the two tracts. The survey of said right of way dated July

18,2001, by Charles W. Junkins, Registered Surveyor, is attached hereto as Exhibit A.
5.) Said right of way has been used by both parties for access to the public road
for many years but there is no documentation thereof in favor of either party.
6.) Naomi T. Glessner was survived by two daughters, your petitioner and her
sister Janet K. Glessner who are equal and sole legatees.
7.) Virginia R. Wilbur is both grantor and grantee of said right of way; she as
executrix is grantor of the right of way to herself and her husband as grantees and she,
together with her husband, are grantors of the right of way in favor of the estate of which
she is executrix.
8.) Janet K. Glessner joins in this Petition by her Joinder attached is Exhibit B.
WHEREFOR your petitioner respectfully prays your Honorable Court to make an
order authorizing the grant ofa right of way over land of Naomi T. Glessner, deceased, to
Virginia Ruth Wilbur and Harold James Wilbur, husband and wife, for access from Hempt
Road (L.R. 21018) to their land and authorize and direct the clerk of court to execute and
deliver an easement to accomplish the same, all as provided by Section 3356 of the Probate,
Estate and Fiduciaries Code (20 Pa C.S.A. 3356).
