Rosendale, your Petitioner, files this Petition for Settlement of a Small Estate under the provisions of Section 3102 of the Probate, Estates and Fiduciaries Code and in support thereof avers that: (1) Your Petitioner, Mary L. Rosendale is a competent adult residing at 45 Sample Bridge Road, Mechanicsburg, Pennsylvania 17050, and is the spouse of the above decedent. (2) Walter G. Rosendale died on May 26, 2013 at the age of 88 years, but prior thereto lived and was domiciled at 45 Sample Bridge Road, Mechanicsburg, Pennsylvania, Cumberland County, Pennsylvania. A copy of decedents Death Certificate is attached hereto as Exhibit"A." (3) Walter G. Rosendale died with a Will. No Letters have been issued. A copy of Decedent's Last Will and Testament is attached hereto as Exhibit`B." (4) Walter G. Rosendale had no probate estate when he died other than the following: Prudential Financial Common Stock with a balance of$3,073.20 as of September 27, 2011 A copy of the Prudential Financial statement is attached hereto as Exhibit"C." (5) The sole heirs and relationship to the decedent are as follows: Mary L. Rosendale, Spouse (6) Your Petitioner avers that there are no outstanding debts of the Decedent. (7) Attorneys Fees in the amount of$750.00 will be charged to the estate. WHEREFORE, your Petitioner respectfully requests that an Order be made authorizing Mary L. Rosendale to act as Fiduciary for the Estate of Walter G. Rosendale and transfer the Prudential Financial Common Stock to Mary L. ROSENDALE, of Silver Spring Township, Cumberland County, Pennsylvania, declare this instrument to be my Last Will and Testament, hereby expressly revoking all Wills and Codicils heretofore made by me. ONE: I direct my Executrix to pay all of my debts, funeral and administrative expenses as soon as may be done conveniently after my decease. Furthermore, I direct that all state, inheritance, succession and other death taxes imposed or payable by reason of my death and interest and penalties thereon with respect to all property composing of my gross estate for death tax purposes, whether or not such property passes under this will, shall be paid by the Executrix of my estate. TWO. My Executrix may, at her discretion, compromise claims, borrow money, retain property for such length of time as she may deem proper; lease and sell property for such prices, on such terms, at public or private sales, as she may deem proper; and invest estate property and income without restriction to legal investments unless otherwise provided hereunder. I authorize and empower my Executrix to sell any realty and/or personalty owned by me at my death and not specifically devised or bequeathed herein, at public or private sale or sales and to give good and sufficient deeds and/or bills of sale therefor, in fee simple, as I could do if living. My Executrix is authorized and empowered to engage in any business in which I may be engaged at my death, for such period of time after my death as seems expedient to said Executrix. THREE: I give, devise, and bequeath all of my estate of every nature and wherever situate to my wife, MARY L. ROSENDALE, provided she survives me by thirty (30) days or more. FOUR: If my wife, MARY L.ROSENDALE, has predeceased me or failed to survive me by thirty (30) days or more, I give, devise and bequeath all the rest residue and remainder of my estate of every nature and wherever situate to the following: A. BRUCE G. ROSENDALE .................... 50% B. WAYNE T. ROSENDALE.................... 50% If one of the above named should predecease me; then their share will be equally distributed to their living issue. In the event they shall die without living issue, then their respective share shall go to the surviving spouse or their issue per stirpes. FIVE: I appoint my wife, MARY L. ROSENDALE, to serve as Executrix of this my Last Will. If she has predeceased me, failed to qualify, or ceased to serve as Executor, I appoint BRUCE G. ROSENDALE to be the Substitute-Executor of this my Last Will. If he has predeceased me, failed to qualify, or ceased to serve as Substitute-Executor, I appoint PATRICIA A. ROSENDALE to be the Substitute-Executrix of this my Last Will.
