STIPULATION AGAINST LIENS
THIS AGREEMENT made this
by and between

JOY-ARK BUILDERS, INC.
hereinafter called the Contractor,
AND
MARC D. HOLLAND and NICOLE G. HOLLAND, husband and wife
hereinafter called the Owner.
WITNESSETH THAT:
The Contractor by instrument dated November 14, 2004
entered into an Agreement with the Owner for the erection and construction of a improved dwelling home
,situatedon Lot 2, Crystal Lake Estates, 2 Grey Goose Circle, Carlisle, PA,
as described in Exhibit "Au.
AND WHEREAS, the Contractor has covenanted and agreed therein to enter into an additional agreement
with the Owner stipulating that no lien or liens of any kind shall be filed against the above building or the
appurtenances thereto.
NOW, THIS AGREEMENT WITNESSETH, that the Contractor, for and in consideration of the awarding to him
of the said contract as for the sum of ONE DOLLAR ($1.00) to him in hand paid by the Owner, the receipt of
which is hereby acknowledged, promises and agrees that no Mechanic's Lien or liens shall be filed against
the aforesaid building or the appurtenances thereto by any subcontractor, subcontractors, materiaimen,
mechanics, iaborers or anyone for materials furnished, work done or services rendered of any kind
whatsoever, for or about, or on account of the aforesaid building or on the credit thereof.
IN WITNESS WHEREOF, the said parties hereunto set their hands and seals the day and year aforesaid.

EXHIBIT "A"
PROPERTY DESCRIPTION
The land referred to in this Commitment is described as follows:
ALL THAT CERTAIN lot or parcel of land known as Lot NO.2 in the Township of Middlesex,
County of Cumberland and Commonwealth of Pennsylvania, more particularly described in a
Subdivision Plan prepared by Hartman and Associates, Inc., approved by Middlesex Township
and recorded in the Office of the Recorder of Deed of Cumberland County, Pennsylvania in
Plan Book 77, Page 148, recorded November 8,1999.
BEGINNING at a point on the curve of Grey Goose Circle in the aforesaid plan, said point
being the most easterly point of the northwest corner of Lot No. 1 on the aforesaid plan;
THENCE along the curve of Grey Goose cul-de-sac with a radius of 60 feet a distance of 51.57
feet to a point being the northwest corner of Lot No. 2 on the aforesaid plan; THENCE
continuing along Lot NO.2 on the aforesaid plan, North 67 degrees 18 minutes 00 seconds
East a distance of 361.30 feet to a point; THENCE continuing along Lot NO.2 on the aforesaid
Plan, North 48 degrees 41 minutes 58 seconds East a distance of 345.59 feet to a point being
the southeast corner of Lot No.3; THENCE South 28 degrees 15 minutes 02 seconds East a
distance of 226.00 feet to a point; THENCE South 51 degrees 27 minutes 25 seconds West a
distance of 388.45 feet to a point being the northeast corner of Lot NO.1 on the aforesaid plan;
THENCE continuing along Lot No.1, North 86 degrees 08 minutes 15 seconds West a
distance of 417.19 feet, the place of BEGINNING.
UNDER AND SUBJECT to all restrictions, easements, rights-of-way and common use areas
noted on the aforesaid Plan or of record.
CONTAINING 127,693.50 square feet, more or less, or 2.9341 acres, more or less.
BEING THE SAME PREMIES WHICH Pheasant Development Corp., a Pennsylvania
Corporation, by its Deed dated August 16, 2004 and to be recorded simultaneously hereto in
the Office of the Recorder of Deeds of Cumberland County, Pennsylvania, granted and
conveyed unto Marc D. Holland and Nicole G. Holland.
