HomeMy WebLinkAbout13-6762 IN RE: APPOINTMENT OF • CUMBERLAND COUNTY, PENNSYLVANIA MENTAL HEALTH OFFICER • CIVIL ACTION—LAW • • 2013-6762 CIVIL TERM ORDER OF COURT AND NOW, this 21st day of November, but effective as of the 1st day of January, 2014, between CUMBERLAND COUNTY COURT OF COMMON PLEAS (Court) and Ron Turo,Esquire, (Attorney). WHEREAS, the Court of Cumberland County desires to appoint an attorney to provide legal representation at mental health hearings for individuals in Cumberland County who are petitioned for involuntary commitment to a mental health facility; and WHEREAS, the Court desires to contract with Attorney to provide said representation; and WHEREAS, the parties hereto desire to set forth the terms and conditions of said contractual arrangement. NOW,THEREFORE, the parties intending to be legally bound hereby agree as follows: 1. Recitals. The above recitals are incorporated herein by this reference. 2. Independent Contractor. Attorney is not an employee of the Court, but is an independent contractor. 3. Administration of Agreement. This Agreement will be administered by the Court of Common Pleas of Cumberland County. Said Court shall appoint Attorney to represent the respondent in mental health hearings. 4. Attorney Obligation. 4.1 Attorney will duly provide representation for respondents at mental health hearings. ` :. 4.2 In the event Attorney is unable to attend a scheduled hearing, Attorney <t shall find substitute counsel at his own expense. Compensation. 5.1 Attorney shall be compensated in the amount of Ten Thousand Six Hundred Twenty-Nine Dollars and Ninety Six Cents ($10,629.96) per year; paid in 12 equal monthly payments of$885.83. Attorney shall submit an itemized statement of hours provided for the previous month to the Court Administrator. 5.2 Mileage. Attorney shall submit monthly to the Court Administrator the number of miles traveled by Attorney in carrying out his or her appointment. Attorney shall be paid mileage at the County approved rate for each mile approved by the Court Administrator. 6. Termination. 8.1 Court Termination. The President Judge may terminate this Agreement without cause pursuant to thirty(30) days written notice. 8.2 Attorney Termination. Attorney may terminate this Agreement pursuant to thirty (30) days written notice to the President Judge; provided, however, as to open matters for those children whom Attorney has been appointed to act as GAL, the President Judge may condition such Attorney termination upon such terms and conditions as the President Judge determines are necessary and economical, provided, however, if such arrangements involve an increase in the County's overall budget for providing needed representation (said budget figures can be obtained from the Commissioners), said terms and conditions must be approved by the County Commissioners. 7. Insurance. Attorney shall maintain Professional Liability Insurance for the coverage and amount approved by the Court Administrator and shall provide proof of same to the Court Administrator. Attorney shall continue such coverage for a period of two years subsequent to the expiration or termination of this Agreement. 8. Term. Morgenthal, Esquire, (Attorney). WHEREAS, the Court of Cumberland County desires to appoint an attorney to act as a review officer at mental health hearings for individuals in Cumberland and Perry County who are petitioned for involuntary commitment to a mental health facility; and WHEREAS, the Court desires to contract with Attorney to provide said service; and WHEREAS, the parties hereto desire to set forth the terms and conditions of said contractual arrangement. Park, Esquire is authorized as a substitute. 5. Compensation. 5.1 Attorney shall be compensated in the amount of Twenty Six Thousand Four Hundred Dollars ($26,400.00) per year; paid in 12 equal monthly payments of $2,200.00. Attorney shall submit a statement for the month to Cumberland and Perry MH/IDD and a copy to the Cumberland County Court Administrator's office. 6. Termination. 8.1 Court Termination.
