COMPLAINT
Plaintiff, Michael C. Messmer, by his attorney, Diane G. Radcliff, Esquire, and files this
Complaint in Divorce of which the following is a statement:
COUNT I
DIVORCE
1. The Plaintiff is Michael C. Messmer, an adult individual residing at 746 Allenview
Drive, Mechanicsburg, Cumberland County, Pennsylvania since September 2003.
2. The Defendant is Wendy D. Seltzer, an adult individual whose last known address was
746 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania and who is
believed to have been residing in Camp Hill, Cumberland County, PA 17011 since on
or about the end of December 2004.
3. Plaintiff and Defendant have been bona fide residents in the Commonwealth for at
least six (6) months previous to the filing of this Complaint.
4. Plaintiff and Defendant were married on July 2, 2004 at Las Cruces, Dona Ana
County, New Mexico.
5. There have been no prior actions of divorce or annulment between the parties.
6. Plaintiff has been advised that counseling is available and that Plaintiff may have the
right to request that the Court require the parties to participate in counseling.
Plaintiff does not request such counseling.
7. Defendant is not a member of the Armed Services of the United States or any of its
Allies.

8. Plaintiff avers that the grounds on which the action is based are:
A. Section 3301lc) Mutual Consent No-Fault: The marriage is irretrievably
broken;
B. Section 3301 (dl Non-Consent No-Fault: The marriage is irretrievably broken
and the parties are now living separate and apart. Once the parties have
lived separate and apart for a period of two years, Plaintiff will submit an
Affidavit alleging that the parties have lived separate and apart for at least
two (2) years and that the marriage is irretrievably broken.

Leave To Withdraw As Counsel and in support thereof state the following:
I. Petitioners Keith O. Brenneman, Esquire and Snelbaker & Brenneman, P. C. are
attorneys ofrecord for Defendant Wendy D. Seltzer in the above divorce proceeding.
2. This divorce proceeding was initiated by Plaintiff Michael C. Messmer by Complaint
filed January 25, 2005.
3. Petitioners Keith O. Brenneman, Esquire and Snelbaker & Brenneman, P. C. are
attorneys of record for Wendy D. Seltzer in her capacity as Plaintiff in a support in a support
case in the Domestic Relations Section docketed to No. 58 Support 2005, PACSES No.
68610767.
4. Michael M. Messmer is represented as Plaintiff in the above-captioned divorce action
and as Defendant in the support matter docketed to No. 58 Support 2005 by Diane G. Radcliff,
Esquire.
5. On May 1,2005 Wendy D. Seltzer communicated directly by email to Attorney Diane
G. Radcliff indicating that all correspondence in the divorce matter should be mailed to Wendy
D. Seltzer's attention at her Camp Hill address and not to her counsel.

6. By the communication made by Wendy D. Seltzer as made reference to in Paragraph
5, above, Wendy D. Seltzer has indicated her intention to represent herself and communicate
directly with counsel for the opposing party to the exclusion of her attorneys of record.
7. The attorneys of record for Wendy D. Seltzer cannot continue to represent her given
her desire not to allow counsel for the opposing party to communicate directly with her attorneys
and due to Wendy D. Seltzer's desire to communicate directly with opposing party's counsel to
the exclusion of her attorneys of record.
8. There will be no prejudice to Wendy D. Seltzer if Keith O. Brenneman, Esquire and
Snelbaker & Brenneman, P. C. withdraw their appearance in this case and the support case
docketed to No. 58 Support 2005.

2. The Motion For Leave To Withdraw As Counsel as referenced in Paragraph I, above,

1. Credibility - just a few examples of lying by Mike Messmer.
- Perjury. Testified under oath that his son did not attempt suicide on approximately 8/6/04 or at
all in support hearing 4/6/05; in fact, he met with Bette Rubin Weinberger, LCSW, 8/25/04, and
Rev. Paul Jones 8/27104 on these dates and stated his son had attempted suicide.
- Lied and stated he closed our bank account on 12/18 - I closed it 4/6/05
- Lied and said he had no outstanding debt to his ex-wife in May and June 2004. We married on
July 2, 2004. In August 2004, he admitted he owed her $20,000.
-Lied to me about the seriousness of all three of his children personal problems which
prevented me from making an informed choice about marriage or even continuing to date him.
2. I was not employed. He was employed.
- I had been on family leave for depression and diabetes since March 22,2004, and thus had no
income. Mr. Messmer promised to make monthly payments on the improvementslproperty I paid
for. I would not have incurred debt otherwise as I could not afford it myself.
3. These debts were not "gifts", as his attorney has insinuated.
4. There are additional debts I incurred for my property he has withheld-but I have no
receipts to prove they are mine.
Electrical supplies, lighting, CD's, my own photographs, beach towels and swimwear belonging
to my son and me, books, cookware, kitchen supplies, ring and picture frame that were a wedding
gift from Mike to me, sheers and drapes (he said he needed them on Y:J05 because he liked to
dance around his bedroom naked), If\

Dear Ms. Radcliff:
I am writing regarding the unresolved financial issues specifically related to this
divorce action. Mr. Messmer has been aware of the amount owed, $5,623.91 for
two years. He testified at the hearing for spousal support that he had indeed
pledged reimbursement to me for the reception. He made verbal agreements to
pay for the other items, as I was not working (with his blessing and
encouragement) and thus, had no income. I demand full payment immediately.
Should the matter require court intervention, I will ask that interest and penalties
be assessed due to the egregious nature of his promise to pay and subsequent
behavior.
Mr. Messmer has documentary copies supporting the amount of money he owes
me, provided again in June 2005. I will be happy to provide'copies to you if
needed. Also, all correspondence should be directed to my attention at P.O. Box
241, Lemoyne, PA 17043.
Once I receive payment in full of $5,623.91, I will agree that all outstanding
economic issues are resolved and we can finalize the divorce.

2.LATE RENTAL PAYMENTS OR DEFAULTS: After 5PM on the fifth (5th) day after the anniversary date, any rental payment not paid In
full will be subject to a late charge of $10.00. Late charges will continue In $15.00 Increments for every subsequent ten.day period the ren-
tal payment continues to be past due. If the late rental payment Is not made by 5 PM on the fifth day after the anniversary date the
Lessor has the right to put his lock on the door of the premises, remove the access number, and/or institute legal action necessary to
collect unpaid rent, any legal fees Involved In the collection, and late charges. If the rental payment Is not received by 5 PM on the fIf.
teenth (15) day after the anniversary date, or the Lessee violates any terms of this lease, It Is agreed that such delault or lallure to pay
shall create a conclusive presu"'ptlon that the property stored In and about the premises has been abandonded. The Lessor may
thereupon enter the leased premises and remove all property to another portion of the storage area, and rent the unit to another lessee.
