CIVIL ACTION - LAW WENDY D. SELTZER, Defendant DIVORCE COMPLAINT Plaintiff, Michael C. Messmer, by his attorney, Diane G. Radcliff, Esquire, and files this Complaint in Divorce of which the following is a statement: COUNT I DIVORCE 1. The Plaintiff is Michael C. Messmer, an adult individual residing at 746 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania since September 2003. 2. The Defendant is Wendy D. Seltzer, an adult individual whose last known address was 746 Allenview Drive, Mechanicsburg, Cumberland County, Pennsylvania and who is believed to have been residing in Camp Hill, Cumberland County, PA 17011 since on or about the end of December 2004. 3. Plaintiff and Defendant have been bona fide residents in the Commonwealth for at least six (6) months previous to the filing of this Complaint. 4. Plaintiff and Defendant were married on July 2, 2004 at Las Cruces, Dona Ana County, New Mexico. 5. There have been no prior actions of divorce or annulment between the parties. 6. Plaintiff has been advised that counseling is available and that Plaintiff may have the right to request that the Court require the parties to participate in counseling. Plaintiff does not request such counseling. 7. Defendant is not a member of the Armed Services of the United States or any of its Allies. -2- 8. Plaintiff avers that the grounds on which the action is based are: A. Section 3301lc) Mutual Consent No-Fault: The marriage is irretrievably broken; B. Section 3301 (dl Non-Consent No-Fault: The marriage is irretrievably broken and the parties are now living separate and apart. Once the parties have lived separate and apart for a period of two years, Plaintiff will submit an Affidavit alleging that the parties have lived separate and apart for at least two (2) years and that the marriage is irretrievably broken. Mr. Messmer has been aware of the amount owed, $5,623.91 for two years. He testified at the hearing for spousal support that he had indeed pledged reimbursement to me for the reception. He made verbal agreements to pay for the other items, as I was not working (with his blessing and encouragement) and thus, had no income. I demand full payment immediately. Should the matter require court intervention, I will ask that interest and penalties be assessed due to the egregious nature of his promise to pay and subsequent behavior.
