Updated 1/1/2011 NOTICE Pennsylvania Rule of Civil Procedure 205.5. (Cover Sheet) provides, in part: Rule 205.5. Butcher,hereby file this Complaint and respectfully state as follows: 1. Plaintiffs Carolyn L. Butcher and Brian T. Butcher, (hereinafter referred to as "Plaintiffs") are married, adult individuals residing at 1670 North River Road, Halifax, Dauphin County, Pennsylvania, 17032. 2. Defendant Stanley Deimler, Jr. (hereinafter referred to as "Defendant") is an adult individual with a last known address of 8 East Pine Street, Enola, Cumberland County, Pennsylvania, 17025. 3. Defendant is the owner of Deimler Automotive located at 110 State Highway, Enola, Cumberland County, Pennsylvania, 17025. 4. The Plaintiffs own a 2005 Chevrolet 3500, Duramax Diesel truck(hereinafter referred to as "vehicle") that required mechanical repair work. The work required on the vehicle was to replace the head gasket. 5. No other repairs were required on the vehicle. 6. In January 2013, the Defendant told the Plaintiffs that he could repair their vehicle for the sum of$3,700.00. 7. An agreement was reached that the vehicle would remain on the Defendant's property until the Plaintiffs paid the sum of$1,850.00. After payment was made, the Defendant would complete the repairs as agreed. Upon completion of the repairs, the Plaintiffs would pay the remaining balance of$1,850.00. 8. On February 28, 2013, the Plaintiffs paid $1,850.00, with check number 670, attached hereto as Exhibit"A". 9. At this time, Plaintiffs verified with Defendant that he was going to purchase and install a"premium head gasket repair kit"on the vehicle. Defendant agreed to this. 10. The Defendant cashed Plaintiffs' check number 670 on March 1, 2013. 11. Between the months of March and May 2013, Plaintiffs called Defendant 13 times to inquire as to the status of the vehicle. 12. The Defendant agreed to remove the heads from the engine and give them to the Plaintiffs. The Plaintiffs agreed to have the heads cleaned at Robert H. Feaser's, a mechanic shop in Harrisburg. 13. In May 2013, the Defendant finally had the engine heads removed and notified the Plaintiffs. 14. The Plaintiffs picked up the engine heads,had them cleaned, and returned them to the Defendant within two (2) days. 15. The mechanic at Robert H. Feaser's revealed to Plaintiff that there were gouges in the aluminum heads, this was a concern that would need to be addressed when the heads were put back on the vehicle. The Plaintiff informed the Defendant of this when the heads were returned to him. 16. The Plaintiffs informed the Defendant in May 2013, that the vehicle repair needed to be completed by early June 2013. 17. The work was not completed by early June 2013. 18. Plaintiffs called Defendant twenty-two (22) times in the months of June, July, and August, 2013. 19. Defendant offered Plaintiffs several excuses as to why the repair was not completed. Throughout the course of many conversations, Plaintiffs realized that Defendant did not know what was wrong with the vehicle or how to fix it. At that point, the vehicle had been in Defendants' possession for six (6)months. 20. On August 28, 2013, Plaintiffs removed the vehicle from Defendant's shop. The vehicle was taken to Team One Auto Group in Harrisburg for diagnosis and repair. 21. The damage to the vehicle, as a direct result of Defendant's work, was extensive. 22. Attached are Exhibits `B", "C", and "D", which are invoices totaling$5,924.81, from Team One Auto Group that detail some of the work done to repair Defendant's vehicle. 23. Also attached is Exhibit"E", which is a picture taken by a technician at Team One Auto Group of a connector affixed to another connector on the vehicle. This is one example of the mistakes made by Defendant while attempting to repair Plaintiffs' vehicle. 24. In the course of repairing the vehicle, Team One Auto Group discovered that Defendant reused exhaust manifold gaskets and bolts instead of purchasing the new,premium kit as agreed to in February, 2013. This is another example of the Defendant's extremely poor workmanship. 25. Plaintiffs are requesting that Defendant pay the sum total of the invoices provided as Exhibits "B", "C", and "D"in the amount of$5,924,81. 26. Plaintiffs are requesting that Defendant pay$2,286.00 in truck payments that were made by Plaintiffs for the months of March, April, May, June, July, and August, 2013 for the unreasonable detention of the vehicle. 27. Plaintiffs are requesting that Defendant pay$1,850.00 for the down payment made on February 28, 2013, since Defendant caused more damage to the vehicle than he repaired. 28. Plaintiffs are requesting that Defendant pay$2,000.00 for final repairs made to the vehicle. This invoice can be provided upon request. WHEREFORE, Plaintiffs respectfully request that this Honorable Court enters judgment in favor of the Plaintiffs and against the Defendant in an amount in excess of twelve thousand, two hundred, sixty-four dollars ($12,264.00), together with costs, an amount requiring compulsory arbitration.
