DUGGAN, the OWNERS of the real estate described below, has or is about to execute a contract with FARINELLI CONSTRUCTION, INC. whose principal business address is 5 Kacey Court, Suite 201, Mechanicsburg, PA 17055 , to construct a single family dwelling upon lands situate at LOT #60, SOUTHVIEW DRIVE, MECHANICSBURG, CUMBERLAND COUNTY, PENNSYLVANIA, and; more particularly bounded and described on Exhibit "A" attached hereto and made a part hereof; and, NOW, THEREFORE, this day of C?-M? XK , 2013, before any authority had been given by FARINELLI CONSTRUCTION. INC. to commence work on said facilities, or purchase materials for same, in consideration of making of the above - described Contract with JOHN F. DUGGAN and MICHELLE F. DUGGAN, Owners, and in further, consideration of One ($1.00) Dollar paid to the general contractor by JOHN F. DUGGAN and MICHELLE F. DUGGAN, Owners, the receipt whereof is hereby acknowledged, it is agreed that no liens or claims shall be filed or' maintained against the Owner's facilities and the land above - described, or upon JOHN F. DUGGAN and MICHELLE F. DUGGAN, the Owners, by the general contractor, or any of its subcontractors, or by any of the materialmen or workmen, or any other person acting through or under them, for or on account of any labor, or materials purchased, or extra labor or materials purchased for, towards, in or about the erection, construction, design and improvement of said facilities, under said contract or otherwise, the right to have, file and maintain such liens or claims against the facilities, the land above - described, and JOHN F. DUGGAN and MICHELLE F. DUGGAN, the Owners, being hereby expressly waived by the general contractor for itself, its subcontractors, all materialmen, or workmen and other acting through or under them. General Contractor d i c y39 t k4k 93 s r. i EXHIBIT "A" ALL THAT CERTAIN piece or parcel of land situate in Upper Allen Township, Cumberland County, Pennsylvania, bounded and described as follows, to wit: BEGINNING at a point on the western dedicated right of way line of South View Drive, said point being on the dividing line between Lots Nos. 60 and 61, on the hereinafter mentioned Plan of Lots; thence continuing along said boundary line, North 47 degrees 27 minutes 21 seconds West, 160.00 feet to a point; thence North 42 degrees 32 minutes 39 seconds East, 130.00 feet to a point on the dividing line between Lots Nos. 59 and 60 on the hereinafter mentioned Plan of Lots; thence continuing along said dividing line, South 47 degrees 27 minutes 21 seconds East, 160.00 feet to a point on the western dedicated right of way line of South View Drive; thence continuing along same, South 42 degrees 32 minutes 39 seconds West, 130.00 feet to a point on the dividing line between Lots Nos. 60 and 61, on the hereinafter mentioned Plan of Lots, the place of BEGINNING. Duggan and Michelle F. Duggan, husband and wife. a
