sound and disposing mind and memory, do hereby make, publish and
declare this for and as my Last Will and Testament, hereby
revoking any and all Wills or Codicils by me at any time
heretofore made.
ITEM I - I declare that I am widowed and that I have two
children surviving me, Alice Hertzler Lehman and Arlene J.
Hertzler Wrightstone.
ITEM II - I specifically give and bequeath my
engagement ring to my daughter, Arlene J. Hertzler Wrightstone.
ITEM III - I give, devise and bequeath all of the rest,
residue and remainder of my Estate, real, personal and mixed,
wheresoever situate, as follows :
(a) One fourth (1/4) to the children of my deceased
son, Simon L. Hertzler, who are Ronald Hertzler,
Suzanne Yinger, June Hertzler, and Traci Hertzler, in
equal shares, per stirpes;
(b) One fourth (1/4) to the children of my deceased
son, Joseph G. Hertzler, who are Terri Lee Hertzler,
Connie Jo Smith and Jeffery Hertzler, in equal shares,
per stirpes;
(c) One fourth (1/4) to my daughter Alice Hertzler
Lehman, per stirpes;
(d) One fourth (1/4) to my daughter Arlene J. Hertzler
Wrightstone, per stirpes.
ITEM IV - My Executrixes and their successors shall
have the following powers for the administration of my estate in
addition to those vested in them by law and by other provisions
of my Will, to be exercised in their sole discretion:
A. To retain any or all assets of
my estate or trust, real or personal,
without regard to any principle of
diversification, risk, or productivity.
B. To invest in all forms of
property including stocks, common trust
funds and mortgage investment funds,
without restriction to investments
authorized for Pennsylvania fiduciaries as
they deem proper, without regard to any
principle of diversification, risk, or
productivity.
C. To sell at public or private
sale, to exchange or to lease, for any
period of time, any real or personal
property and to give options for sales,
exchanges or leases, for such prices and
upon such terms and conditions as they
deem proper.
D. To borrow money from any person or
institution including my Executrixes and
to mortgage or pledge any or all real or
personal property as my Executrixes, in
their sole discretion, shall choose,
without regard for the diapositive
provisions of this instrument .
E. To compromise any claim or
controversy.
F. To exercise any option, right or
privilege granted in insurance policies or
in other investments.
ITEM V - I nominate and appoint my daughters Alice
and Arlene as my Co-Executrixes, or the survivor of them. If
both my daughters predecease me or are unable to serve as my
Executrixes, then I nominate and appoint my grandson Brian
Wrightstone as my successor Executor.
ITEM VI No bond or other security shall be required in
any jurisdiction of my Executrixes or my Successor Executor for
the performance of their duties.
