Plaintiff Harleysville Mutual Insurance Company is an insurance carrier licensed and authorized to conduct business in the Commonwealth of Pennsylvania and having as one of its principal places of business the above captioned address. 2. Asheley N. Rotz / Jeffrey Walters are adult individuals insured with Plaintiff Harleysville Mutual Insurance Company on 04/01/2012. 3. Aiden Rotz, Olivia Walters and Paul Walters are minor individuals who were insured under a personal automobile policy with Harleysville Mutual on 4/12/2012. 4. Defendant Kara M.Allen is an adult individual residing at the above captioned address. 5. On or about 04/01/2012, Plaintiff Harleysville Mutual Insurance Company insured Asheley N. Rotz / Jeffrey Walters with personal automobile policy, policy number PAAA93284 , said policy covering "a 2010 Acura automobile carrying with same collision and UMBI coverages. 6. On or about 04/01/2012 at or near the intersection of S. Hanover Street at Nobel Street, Carlisle, Cumberland County, PA, Defendant Kara M. Allen while operating 1995 White Ford bearing PA tag #HXP4851 ,did negligently or recklessly strike /collide into Plaintiff's insured's 2010 Acura causing damages to same in the amount of $22,184.24 (said figure includes rental expenses and first party deductible). 7. As a result of the violent collision the Plaintiff sustained bodily injuries. 8. The negligence of the Defendant consisted of a) failing to yield right of way; b) being inattentive; c) striking another motor vehicle lawfully.upon the roadway; d) failing to give due regard to the rights, safety point and position of Plaintiffs insured's vehicle; e) disregarding a red traffic light; f) improper turning methods, g) other such negligence that may be developed through continuing discovery and trial of this matter. 9. The aforesaid collision resulted solely from the negligent acts and /or failure to act on part of Defendant named herein and was due in no manner whatsoever to any act and/or failure to act on part of Plaintiff s insured. 10. As a result of the aforesaid collision the Plaintiff Asheley N. Rotz / Jeffrey Walters and three minors sustained injuries to and about their persons requiring medical attention and treatment, said injuries included but were not limited to neck, back, foot, shoulder, chest, etc. 11. As a result of the aforesaid policy of insurance, Plaintiff. Harleysville Mutual Insurance Company settled the UMBI claims of Plaintiffs, Asheley N. Rotz / Jeffrey Walters and thee three minors in the amount of $52,000.00 (representing policy limits and fair and reasonable reimbursement for said injuries). 12. Pursuant to the aforesaid policy of insurance, Harleysville Mutual Insurance Company is subrogated to Asheley N. Rotz / Jeffrey Walters for this loss WHEREFORE, Plaintiffs demand judgment against the Defendant in the amount of $74,184.24 together plus costs, interest and such other relief this Court finds equitable and just.
