Meals—Disclaimer—File 2113-0281 Dear Office of Chief Counsel: James S. Meals received a letter dated December 13, 2013, from the Department of Revenue stating that the Estate Account of his father, George C. Meals, File#2113-0281 was in delinquent status. On December 27, 2013, a Rev1500 Form was filed with the Register of Wills, Cumberland County, Pennsylvania, a copy is attached to this letter. This letter is to request a formal determination from the Department that there is zero Pennsylvania Inheritance Tax liability on File #2113-0281 as all the assets of George C. Meals passed to Dolores Meals, his surviving spouse. The background of events is listed below. Several years prior to his passing, George C, Meals, decedent, Dolores Meals, wife, and their two children James Meals and Torian (Meals) McCormick created joint checking, savings, and investment accounts, each with rights of survivorship as listed below: 1. Citizens Bank Circle Gold Checking Account# 622455-658-3. Jointly owned with rights of survivorship by Dolores Meals, George C. Meals, and Torian Meals(McCormick). 2. Citizens Bank Circle Money Market Account# 622455-659-1. Jointly owned with rights of survivorship by Dolores Meals, George C. Meals, and Torian Meals (McCormick). 3. PNC Premium Money Market Account# 50-0520-3088. Jointly owned with rights of survivorship by Dolores Meals, George C. Meals,and Torian Meals (McCormick). 4. PNC Wealth Management Investment Management Account#27-27-007-3988702. Jointly owned with rights of survivorship by Dolores Meals, George C. Meals, Torian Meals (McCormick), and James S. Meals. 5. Meals predeceased the other joint owners on the accounts. .Approximately February or March of 2013, James Meals received a notice that Inheritance Taxes were owed on a PNC Bank Account#5005751025 due to his joint ownership in the amount of$94.38. That amount was paid by check#1800. In July 2013, while helping Dolores Meals with updating her estate plan, I realized the existence and titling of the joint assets and advised Mrs. Meals of the potential tax liability of children inheriting joint assets upon a parent decedent's death. On July 31, 2013, in compliance with 20 Pa. C.S.A. Chapter 62, James Meals and Torian (Meals) McCormick executed disclaimers (see attached) and gave them to Mrs. Meals. On the same date, Mrs. Meals executed her new estate plan. All documents were witnessed and notarized. Mrs. Meals gave both her children a copy of the documents and, thinking no tax was owed, put the originals, including the disclaimers, with her own estate planning documents. The attached signed, notarized disclaimers meet the requirements of IRC Section 2518(b) and 20 Pa. C.S.A. Chapter 62. James Meals and Torian (Meals) McCormick did not fund the accounts. At all times from December 2012 to date, James Meals and Torian (Meals) McCormick unequivocally refused the joint assets of their father and received no tangible benefits. At the same time, Dolores Meals has accepted the assets and declared the income, losses, and dividends on her personal tax returns. These accounts were established for the purpose of funding the retirement of Dolores Meals and George C. Meals. The children's names were added to the account"just in case". I contacted the Department on or around December 19, 2013, to discuss the background of this file and the failure to file the Rev1500. I notified the Department of the disclaimers and asked if the acceptance of a signed, notarized disclaimer filed with the surviving spouse, sole owner, and representative of the estate in lieu was sufficient under Pennsylvania law. The representative "thought" this would be sufficient, but asked me to request a determination from Counsel. 20 Pa. C.S.A. Section 6204 does not appear to address delivery of disclaimer of joint assets that are not directed by will, intestacy, beneficiary designation, power of appointment or real estate. 20 Pa. C.S.A. Section 6201(b) allows disclaimers to be effective when delivered to the person who is entitled (to the property)by reason of the disclaimer. We ask the Department consider that all the interest in the disclaimed property was initially contributed by and then inured to the benefit of the surviving spouse and determine that the assets above should be taxed at the spousal rate of 0%.
