Sakol and Carolyn M. Anner, by their attorney, Cunningham& Chernicoff, P.C.,to file the following Motion; 1. Plaintiffs, Peter J. Sakol and Carolyn M. Anner(the "Plaintiffs") commenced this action against Defendants, Greta and Brad Olsen(the "Defendants")by Writ on February 5, 2002. 2. Plaintiffs filed a Complaint against Defendants on April 2, 2002. 3. On April 26, 2002, Defendants filed an Answer with New Matter to Plaintiffs Complaint. 4. On May 1, 2002, Plaintiffs replied to Defendants'New Matter, closing the pleadings. 5. After Discovery commenced, on March 27, 2003, Plaintiffs filed a Motion for Protective Order("Motion"). In the Motion, Plaintiffs noted that documents that would be responsive to various of Defendants' discovery requests, including tax schedules, W-2's, an arbitration award, and contracts of employment contained personal information that they sought to keep confidential. 6. The Motion, attached and incorporated herein as Exhibit "A", contained an unrelated compilation of the documents sought to be protected in the Motion. 7. On April 1, 2003, the Honorable J. Wesley Oler, Jr. issued a Rule to Show Cause upon Defendants directing them to show cause why the Motion should not be granted. 8. On April 9, 2003, Defendants filed an Answer to the Rule to Show Cause opposing the Motion. 9. As of this date, the Motion and its related Exhibits are available on the Cumberland County Prothonotary's online website, currently allowing the public unrestricted access to said documents. These documents begin on Page 50 of the docket and conclude on Page 62 of the docket. 10. No further Order was issued in connection with the Motion. 11. On April 21, 2003, Plaintiffs filed a response to Defendants' Requests for Admission which remains available on the Cumberland County Prothonotary's Public Access Docket Report, and is available without restricted access to the public. These materials begin on Page 73 of the docket and conclude on Page 80 of the docket. 12. On June 3, 2004 Plaintiffs filed a Praecipe to Discontinue the action against Defendants, the matter having resolved. 13. As of June 3, 2004, Defendants were represented by the law firm of Jacobs & Saba. 14. After the Praecipe to Discontinue was filed, the law firm of Snyder and Dorer (Dorer and Snyder f/k/a Jacobs & Saba) has succeeded Jacobs & Saba. 15. Plaintiffs request and now seek to protect certain confidential and personal financial information and redact social security numbers on documents now available publicly on the Cumberland County Prothonotary's Docket Report at Page Numbers 52 through 62 and 73, 74 and 76. 16. Most of the documents Plaintiffs seek to redact from public view currently display full social security numbers for Plaintiff, Peter J. Sakol. 17. Furthermore, Plaintiffs seek to protect their confidential and personal financial information from public view, as the case has concluded, and there is no need for their personal financial information to be made available publicly. 18. Because of the pending Motion and the prior resolution of the underlying dispute, Plaintiffs propose the form of the attachment, Exhibit "B", to replace Page Numbers 50 through 62, 73, 74 and 75 of the Docket Report. 19. Defendants' counsel, Donald R. Dorer, Esquire, for Snyder& Dorer f/k/a Jacobs & Saba, does not oppose Plaintiffs' Motion. Sakol, M.D. and Carolyn M. Anner, husband and wife, and Carolyn M. Anner, in her own right, by and through their attorneys, SCHMIDT, RONCA & KRAMER, P.C., and respectfully moves the Court as follows: 1. The above-captioned matter is a personal injury case resulting from an automobile accident, which occurred on June 4, 2001. 2. The Plaintiff, Peter J. Sakol, M.D., suffered injuries, to his neck, back and knee as a result of the accident. 3. The Plaintiff, Peter J. Sakol, M.D., filed a Complaint in the Court of Common Pleas of Cumberland County. 4. The Plaintiff, Peter J. Sakol, M.D., is a physician licensed to practice medicine in the Commonwealth of Pennsylvania. 5. The Plaintiff, Peter J. Sakol, M.D., pled in the Complaint that he has suffered a loss of earning capacity. 6. Discovery is being exchanged between the parties. 7. The Defendant has requested salary, wage, and employment information concerning Dr. Sakol and his practice. 8. The Plaintiff, Peter J. Sakol, M.D., is currently in private practice and has contracts to do Medicare Fraud Reviews. 9. The Plaintiff, Peter J. Sakol, M.D., is previously an employee of Premier Eye Group. 10. The documents that the Plaintiff, Peter J. Sakol, M.D., currently has that would be responsive to the discovery requests include income tax schedules, W-2s, an Arbitration Award, and contracts of employment. 11. The Plaintiff, Peter J. Sakol, M.D., is willing to produce these documents, but requests that they be kept confidential except as necessary to prepare a defense in this case. 12. The Plaintiff, Peter J. Sakol, M.D., has produced some of these documents with a requested stipulation, which is attached as Exhibit "A." • 13. The Defendants, Greta and Brad Olsen, have not agreed to the confidentiality request. 14. The Plaintiff, Peter J. Sakol, M.D., brings this Motion for Protective Order under Rule 4012(a)(9) indicating that these documents include commercial information, which should be kept confidential. 15. The Plaintiff, Peter J. Sakol, M.D., is willing to allow Defendants' counsel to examine the documents, have their experts examine the documents, and request that the information not be used in any other litigation or for any other purpose without written consent of the Plaintiff, Peter J. The income and expenses of your practice was reported on Schedule C (copy enclosed), which is attached to your individual income tax return Form 1040. Your Schedule C showed a net profit of or 2001. However, there were legal expenses deducted in the amount of 41100 which were a one- time type of expense for various legal matters. Additionally, there was a 41.111ftinunediate depreciation deduction for fixed assets you acquired during 2001, which is allowed as a tax deduction under Section 179. The Motion, attached and incorporated herein as Exhibit "A", contained an unrelated compilation of the documents sought to be protected in the Motion. 7. On April 1, 2003, the Honorable J. Wesley Oler, Jr. issued a Rule to Show Cause. upon Defendants directing them to show cause why the Motion should not be granted. 8. On April 9, 2003, Defendants filed an Answer to the Rule to Show Cause opposing the Motion. 9. As of this date, the Motion and its related Exhibits are available on the Cumberland County Prothonotary's online website, currently allowing the public unrestricted access to said documents.
