Fox, hereinafter the "Decedent," died February 11, 2012, having left a Last Will and Testament dated June 10, 2011; and WHEREAS, Judith A. Fox has been duly appointed Executrix of the Estate of the Decedent, hereinafter the "Estate;" and Executrix from any and all claims and liabilities of any kind or nature whatsoever arising from or related to her services or status as Executrix of the Estate. The Beneficiaaries further agree to refund to the Estate any amount which may be necessary in the future to discharge any liabilities of the Estate of which the Beneficiaries may hereafter receive notice. The Executrix has no knowledge of any such claims and believes all matters have been satisfied. (5) It is the expressed intention of the parties hereto that the legal effect intended by this Agreement be the same in each and every respect as would be obtained had a Decree of Distribution in the Estate been entered by the Orphans' Court Division of the Court of Common Pleas of Cumberland County, Pennsylvania, which Decree had become final and unappealable. (6) This Agreement shall be interpreted pursuant to and governed by the laws of the Commonwealth of Pennsylvania, and shall inure to the benefit of and be binding upon the parties hereto, their personal representatives, heirs at law, successors and assigns, as the case may be.
