Whereas, Mark W. Yenser, Jr. and Tammy L. Yenser, hereinafter called the Owner, are about to execute
contemporaneously with Home Designs Unlimited, LLC of , hereinafter called the Contractor, a
contract for the erection or construction of a SINGLE FAMILY DWELLING upon the lot of ground known as 6 Locust
Court, Boiling Springs, PA 17007,South Middleton Township, Cumberland County, Pennsylvania, described in Exhibit "A"
hereof, of which Mark W. Yenser, Jr. and Tammy L. Yenser are the title holder of record, as more particularly described as
Instrument No. 201332021; and
Now, December 23, 2013, at the time of and immediately before the execution of the principal contract, and
before any authority has been given by the Owner to the Contractor to commence work on said building or improvement,
to purchase materials for the same, it is hereby stipulated and agreed by and between said parties as part of said contract
and for the consideration therein set forth, nether the undersigned Contractor, any Sub - contractor or material man, nor any
other person furnishing labor or materials to the said Contractor under the contract entered into between said parties shall
file a lien for work done or material furnished to said building, improvements or any part thereof.
This stipulation is made and intended to be filed with the Prothonotary within 10 days after date in accordance
with the requirements of the Act of August 24, 1963, P.L. 497, as amended,

Pennsylvania, Lot No. 142 on the Final Subdivision Plan of Indian Hills — Section No. 4, recorded in the Office
of the Recorder of Deeds in and for Cumberland County, Pennsylvania, in Plan Book 92, Page 109, the same
being numbered as more particularly described as follows:
BEGINNING at a point along the southern 50 foot wide right -of -way along Locust Court; thence along the dividing
line between Lot No. 142 and Lot No. 143, South 61 degrees 55 minutes 45 seconds East 200.36 feet to a point; thence
along the dividing line between Lot No. 142 and Lot No. 130 of Section 2, Indian Hills Subdivision, North 20 degrees 11
minutes 44 seconds East 140.89 feet to a point; thence along the dividing line between Lot No. 142 and Lot No. 141, North
78 degrees 11 minutes 04 seconds West 197.96 feet to a point; thence along the southern 50 foot wide right -of -way line
along Locust Court; thence by a curve to the right with a radius of 225.00 feet, an arc length of 63.83 feet, a chord bearing
of South 19 degrees 56 minutes 36 seconds West, and a chord length of 63.62 feet to a point; thence continuing along the
southern 50 foot wide right -of -way line along Locust Court, South 28 degrees 04 minutes 15 seconds West 21.17 feet to the
point and place of BEGINNING.
