NEER, domiciled and resident at 70 Greenfield Drive, Township of South Middleton, Cumberland County, Commonwealth of Pennsylvania, declare that this document is my Will and revoke all my previous Wills and Codicils. I. IDENTIFICATIONS AND DEFINITIONS I am married to FRANCIS O. NEER. I have no children. II. PAYMENT OF EXPENSES, DEBTS, AND TAXES I direct my Executor to pay medical, funeral, and administrative expenses and all taxes payable by reason of my death, before any division of my estate. My Executor shall not attempt to have any part of such taxes apportioned among the recipients of property includible in determining the amount of such taxes. Proceeds on insurance on my life up to the maximum allowable as an exemption from Pennsylvania Inheritance Tax and distributions from pension and profit sharing plans exempt from federal estate tax, all of which are payable to my Trustee or any beneficiary (other than my estate), shall not be used to pay debts, taxes, expenses of administration or other charges against my estates. It is my express desire that my remains be cremated and the arrangements be handed by Ewing Brother's Funeral Home and that my remains be buried in the Stambaugh family lot in Cumberland Valley Memorial Gardens. III. SPOUSE SURVIVING My husband and I married later in life. He was previously married with a daughter to that marriage. My husband, Frank, and I have our own separate estates. We own an automobile and a home together. It is our intention that should I die before him or that if he would die before me, the survivor would hold title to the automobile and the house until such time that the survivor would no longer have use for the automobile or home. At that time the automobile or home shall be liquidated and the proceeds therefrom would be equally divided between our individual estates or to our heirs (my brothers and sisters or Frank's daughter), provided, however, that I had not purchased my spouse's share as contemplated in the next sentence. In the alternative, if it is feasible and prudent to do so, and in an effort to keep the distribution of our assets equitably divided among our separate estates, Frank may have the vehicle and home appraised and pay my estate one half the then appraised value of these items. ,~,;.) Tangible Personal Propertv - My husband and I have many pieces of tangible personal property which were brought into our marriage and which we desire to remain in our respective families. Of this personal property the master bedroom set ""J .,.11 J:l,~lli.J.:"o' in the master bedroom are given to Kim and Glen Van Fleet. On all other items of tangible personal property we have place a color, adhesive circle on each item. The circles are colored either, green, red or yellow. Any item having a green circle was brought into the marriage by me and my family should have the first option to take any or all of these items. Any item having a red circle was brought into the marriage by my husband Frank and his daughter and her family should have the first option to take any of these items. Items having a yellow circle were obtained by Frank and me during the marriage. Such items should be divided among our families as my Executor determines appropriate, in shares of substantially equal value. I recommend, but do not require, that all such items of tangible personal property be appraised and that the families select in rotation items at the appraised value, the order of choice to be determined by lot. RESIDUAL BENEFICIARIES The rest and remainder of my estate shall be equally be divided between my brother Dean Stambaugh, my sisters Jean Blosser and Faye Truxal who survive me. VI. FIDUCIARIES Executrix: I nominate and appoint my husband, FRANCIS O. NEER, as Executor of this Will to serve without bond. If he does not survive me, declines to act, or having qualified, resigns, dies, or is removed, I nominate KIM V AN FLEET, to serve as sole Executor to serve without bond. Powers: I give my fiduciaries, including successor fiduciaries, all the powers contained in Chapter 71 of the Pennsylvania Probate, Estates and Fiduciaries Code at the time of the execution of this Will, and those powers are incorporated by reference. VII. MISCELLANEOUS Survival Defined: No person shall be deemed to have survived me or to be living at my death if he/she shall die within thirty (30) days after my death. Implied Contract: This Will is being executed on the same date as is the Will of my wife; and it is our intent that certain provisions relating to the disposition of our tangible personal property and our real property be considered joint or mutual, it being our express intention that the survivor be restricted in the disposition of our jointly owned property.
