ESTATE OF
MILDRED E. VOGELSONG,
PETITION FOR GRANT OF LETTERS
AND NOW COMES, Leroy R. Miller Jr., Petitioner herein, who petitions this Court as
follows:
1. Mildred E. Vogelsong died on January 14, 2001. A copy of her Death Certificate is
attached hereto and marked Exhibit "A".
2. Mildred E. Vogelsong died testate with a copy of her Will dated March 23,1992,
being attached hereto and marked Exhibit "8".
3. At the time of her death, there were no known codicils to said Last Will and
Testament.
4. The Last Will and Testament of the decedent is not a self-proving Will, however, it
was witnessed by 1. Robert Stauffer and Ruth Ann Fulwider.
5. J. Robert Stauffer will appear in the presence of the Register of Wills to take an oath
of Subscribing Witness.
6. Ruth Ann Fulwider was a former employee of J. Robert Stauffer and has moved from
the Commonwealth.
7. Leroy R. Miller, Jr., neighbor, friend and Petitioner herein will take an oath of Non-
Subscribing Witness,

8. At the time of her death, the decedent was 92 vears old.
9. At the time of her death, decedent had an equitable interest in the property located at

23 West Coover Street, Mechanicsburg, Pennsylvania in the approximate amount of $39,076.40.
There were no other assets in the decedent's estate.
10. In the Will of Mildred E. Vogelsong, she appoints the First Bank and Trust Company
of Mechanicsburg, now known as PNC Bank N.A. PNC Advisors, as the Executor of her estate.
11. PNC Bank N.A. PNC Advisors desires to renounce its appointment as Executor and
in that regard their renunciation is attached hereto and marked Exhibit "C".
12. The residuary legatee in the Last Will and Testament of Mildred E. Vogelsong i~
Paul's United Church of Christ, 626 Williams Grove Road, Mechanicsburg, Pennsylvania. St.
Paul's United Church of Christ desires to renounce its appointment as administrator pursuant to
20 Pa. C.S.A. Section 3155. St. Paul's United Church of Christ as residuary legatee under the
Will would be the next in line to be appointed as Administrator of the Estate. St. Paul's United
Church of Christ renounces their right to letters of administration pursuant to 20 Pa. Section
3155 (b)(6) and appoints as Administrator of the Estate, Leroy R. Miller Jr.
13. Leroy R. Miller Jr. is an adult individual who was Mildred E. Vogelsong's neighbor
and friend since 1979.
14. Leroy R. Miller Jr. resides at 25 West Coover Street, Mechanicsburg, Pennsylvania
and Mildred E. Vogelsong resided at 23 West Coover Street, Mechanicsburg. Pennsylvania until
she moved to Messiah Village located in Mechanicsburg, Upper Allen Township, Cumberland
County, Pennsylvania.
15. Leroy R. Miller Jr. and his wife, Constance K. Miller, are purchasing the property at
23 West Coover Street, Mechanicsburg, Cumberland County, Pennsylvania on an Installment
Sales Agreement dated May 6, 1996 from Mildred E. Vogelsong.
16. Mildred E. Vogelsong was a victim of a fraudulent crime in that her assets were
mismanaged and fraudulently converted by an individual named Robert Spangler.
17. Robert Spangler was convicted of criminal acts for his actions in the Cumberland
County Court and there is an order of restitution against Robert Spangler.
18. Through contact with the Cumberland County Collections Office of the Probation
Office there have not been any monies collected on the Order of Restitution to date.
19. It is requested that this Court appoint Leroy R. Miller Jr. as Administrator of the
Estate of Mildred E. Vogelsong pursuant to 20 Pa.C.S.A. Section 3155.

of the Department of Public Welfare's statement of claim that it didn't show
the one payment that we had received in December 2001.
Neighborhood Services in Lancaster, Pa. sent us $3,104.76 which were
the funds in her personal care account. The new balance due the Department
is $48,019.60. If you have any questions, please give me a call.
