No. C) 0 0 ��} 10 "1 Amount of Note: $120,000.00 Date of Execution: o�.��! �,-� ° t , 2014. , =T Place of Execution: �ec.•n� {-�.1 . �� `� -- c Mortgaged Property: 745 Hummel Avenue, Lemoyne, PA., 17043 r - - � FOR VALUE RECEIVED, Clayton Murray, ( "Maker "), an adult individual whose address is 813 Hummel Ave., Lemoyne, PA., 17043, promises to pay to the order of Frank Kindler, ( "Payee "), whose address is 107 St. John's Church Rd., Camp Hill, PA., 17011, the principal sum of $120,000.00, with 4.5% interest for 4 years 9 months from date first above written on the outstanding balance of the principal sum then to the prevailing rate PROVISO: said rate of interest shall not exceed 7 %. The term of the Note is 15 years from the present date first above written. PAYMENT OF PRINCIPAL AND INTEREST 1. Principal and interest shall be payable in lawful money of the United States of America at the office of the Payee or such other place as the holder of this Note may designate in successive monthly installments of $ ° (l K � each, on the first day of each month commencing on Feb.- o r - , 2014, and shall be applied first to payment of interest as accrued and the balance to the payment of principal. The Maker shall have the privilege without premium or penalty at any time and from time to time of prepaying this Note in whole or in part provided that each prepayment shall be accompanied by accrued interest on the amount prepaid. MORTGAGED PROPERTY 3. This Note is secured by a mortgage of the same date as this Note covering certain premises ( "Mortgaged Property ") located at 745 Hummel Avenue, Lemoyne, PA., 17043. Any failure by the Maker to comply with the instant terms, covenants, or conditions of this Note shall automatically constitute a default under this Note. NO TRANSFER 4. If the Maker shall without in each instance obtaining the prior written consent of the Payee, sell, transfer, lease, or convey the Mortgaged Property or any interest in it other than leases of portions of the Mortgaged Property in the ordinary course of Maker's business, whether voluntarily or by operation of law, then, at the option of the Payee, the maturity of this Note shall be advanced to the date of the transfer, and the obligations of the Maker under this Note shall immediately be due and payable. EVENTS OF DEFAULT S. If the Maker fails to pay any sum when due or within 10 days after it becomes due or if the Maker shall in any other way be in default under this Note or if any certification, warranty, or representation made by the Maker to the Payee proves to be materially false, or if the Maker shall be in default under the terms of the Mortgage after expiration of any applicable notice of grace period contained in the mortgage, then the entire unpaid principal balance of this Note, together with interest accrued and with all other sums due or owed by the Maker under this Note shall at the option of the Payee and without notice to the Maker become due and payable immediately with interest. Payment of these amounts may be enforced and recovered by entry of judgment on this Note and the issuance of execution on the judgment. CONFESSION OF JUDGMENT 6. The Maker hereby irrevocably authorizes and empowers any attorney or the Prothonotary or Clerk of any Court of record in the Commonwealth of Pennsylvania to appear for the Maker in any Court in an appropriate action brought against Maker at the suit of the Payee on this Note and to confess judgment against the Maker for all sums due by the Maker, together with costs of suit and attorneys' fees for collection. This warrant of attorney shall be effective only after default. PAYMENT OF COSTS, TAXES 7. Notwithstanding the foregoing provisions of this section, Maker shall at all times be responsible for payment of local taxes, insurance, costs and expenses of maintaining said property pursuant to local or state ordinance or law and shall warrant to preclude the intentional or negligent waste of the Mortgaged Property. NOTHING contained in this Note shall be deemed to release, affect or impair the indebtedness evidenced by this Note or the security for the Note or the Payee's rights to enforce its remedies under said Note including any remedy for injunctive or other equitable relief.
