1. I am a Vice President of New York Community Bank, a New York banking
organization ( "NYCB ").
2. I make the statements herein of my own personal knowledge, except where stated
on information and belief, which statements I believe to be true.
3. On or about May 21, 2012, NYCB obtained a judgment against Defendants
BEAVER CREEK LAND DEVELOPERS, LLC, R. GARTH ULLOM, RGU MANAGEMENT,
LLC, and ROCK VIEW VISIONS, LLC, in the amount of $626,621.43 in the Superior Court of
Yavapai County, Arizona, at docket no. V- 1300 -CV- 201180422 (the " Yavapai County
Judgment ").
4. NYCB received a single payment of $75,000 on the Yavapai County Judgment
and the judgment remains unsatisfied (after credit for the $75,000 payment received).
5. The balance owed to NYCB is $665,571.41 to December 31, 2013, as follows
(plus interest of 10.25% on $558,154.42 after December 31, 2013):
Base Judgment $626,621.43

23 ( "Plaintiff') Motion for Entry of Judgment by Default against Beaver Creek Land Developers,

25 "Defendants "), under Rule 55(b)(1), Ariz.R.Civ.P., the Court, having reviewed the pleadings of

1 properly served with the Complaint, Summons, and Certificate of Compulsory Arbitration, that
2 Defendants have failed to appear or otherwise defend against Plaintiffs Complaint and the
3 claims therein within the period prescribed by law, or at all, and that Plaintiff is entitled to the
4 relief requested. Based upon the foregoing findings, and for good cause appearing therefor,
5 IT IS ORDERED, ADJUDGED, AND DECREED that Plaintiff be awarded judgment
6 against Defendants, as of March 31, 2012, as follows:
7 1. Awarding unpaid principal in the amount of $522,000.00;
8 2. Awarding an escrow advance in the amount of $12,185.52;
9 3. Awarding late charges in the amount of $688.90;
10 4. Awarding appraisal fees in the amount of $4,000.00;
11 5. Awarding accrued interest in the amount of $64,467.01;
12 6. Awarding attorneys' fees in the amount of
13 7. Awarding taxable costs in the amount of $960.00;
14 8. Awarding interest accruing on the amounts in paragraphs 1, 2, 3, 6 and 7 at the
15 rate of 10.25% per annum from January 5, 2012, until paid in full; and
16 9. Directing that there is no just reason for delay, and that this judgment shall be
17 entered as a final judgment, under Rule 54(b), Ariz.R.Civ.P.
