PETITION TO REDUCE THE NUMBER
OF ELECTED COUNCIL MEMBERS FROM
SEVEN (7) TO FIVE (5)
AND NOW comes the Petitioner, the Council of the Borough of Newburg, who
submits this Petition to reduce the number of Council Members from seven to five and in
support thereof avers as follows:
I. The Borough of Newburg is a borough in Cumberland County duly organized
and existing under the laws of the Commonwealth of Pennsylvania, with a mailing
address of P.O. Box 51, Newburg, Pennsylvania.
2. The Borough of Newburg, according to the 2000 census, has a population of
372.
3. Presently, the Borough Council is to consist of seven elected members.
4. The Borough has experienced serious difficulty in finding residents to serve
on the Borough Council.
5. Since October 2004, Council has had two unfilled vacancies, which it is unable
to fill.
6. The Borough Council has received a Petition, a copy of which is attached
hereto and incorporated herein by reference thereto as Exhibit A, signed by twenty-seven
(27) Borough residents who petition to reduce the number of Council members from
seven to five.
7. There were 204 registered electors in the Borough for the November 2004
election.
8. The 27 residents who signed the attached Petition constitute more than five per
cent of the number of electors in the Borough.
9. The Borough Council has by Resolution dated January 17, 2005, a copy of
which is attached hereto and incorporated herein as Exhibit B, supports the reduction in
Council from seven (7) to five (5) members.
10. For boroughs with less than 3000 residents, Section 818 ofthe Borough Code
(53 P. S. 945818) grants authority to the Court of Common Pleas to reduce the number of
Council members from seven (7) to five (5) under the averments made above.
WHEREFORE, Petitioner respectfully requests this Honorable Court issue an
order reducing the number of elected members on the Council for the Borough of
Newburg from seven (7) to five (5) after a hearing on the matter.

A RESOLUTION OF THE BOROUGH OF NEWBURG
TO FILE THE PETITION OF SIGNATURES WITH THE PETITION TO THE
COURT TO REDUCE THE NUMBER OF COUNCIL MEMBERS FROM 7 TO 5.
WHEREAS, the Borough of Newburg has obtained the number of signatures to
Jile a petition with the courts to reduce the number of council members from 7 to 5. The
number of signatures required is 5% of the registered voters. The number of signatures
exceeded the 5%.
NOW, THEREFORE, BE IT RESOLVED AND IT IS HEREBY
RESOLVED that the Borough of Newburg do hereby agree to file the petition of
signatures with the petition to reduce the number of council members from 7 to 5 to the
Court of Common Pleas of Cumberland County, Pennsylvania.
