DISSINGER, individually Defendants JURY TRIAL OF TWELVE DEMANDED COMPLAINT AND NOW, comes Plaintiff, Kegel's Produce, Inc., by and through its attorneys, MARTS ON DEARDORFF WILLIAMS & OTTO, and hereby avers as follows: 1. Plaintiff, Kegel's Produce, Inc., is a Pennsylvania corporation with a registered address at 2851 Old Tree Drive, Lancaster, Lancaster County, Pennsylvania. 2. Defendant Darrylz, Inc. d/b/a Darrylz Hometown Grille is a Pennsylvania company with a place of business at 6085 Allentown Boulevard, Harrisburg, Dauphin County, Pennsylvania. 3. Defendant Daryl K. and Melissa J. Dissinger d/b/a Darrylz Hometown Grille operate a business at 433 North 21st Street, Camp Hill, Cumberland County, Pennsylvania. 4. Defendant Daryl K. and Melissa J. Dissinger are adult individuals residing at 2303 Forest Lane, Harrisburg, Dauphin County, Pennsylvania. 5. Plaintiffis in the business of providing goods and services, mainly produce, to certain businesses and individuals. 6. Defendants maintain two restaurants which operate under the name Darrylz Hometown Grille. 7. Plaintiff has provided both goods and services to Defendants at 6085 Allentown Boulevard, Harrisburg, Dauphin County, Pennsylvania. 8. Plaintiff has provided both goods and services to Defendants for a total value of $10,446.01. A true and correct copy of Plaintiff's invoice is attached hereto as Exhibit "A." 9. Defendants have failed to pay for such goods and services. 10. Despite repeated demands, no payments have been made by the Defendants for amounts due. COUNT I - BREACH OF CONTRACT II. Plaintiff hereby incorporates by reference the averments contained in paragraphs I through 10 as if fully set forth. 12. Defendants have breached an expressed or implied agreement, directly or through agents, to pay for the goods and services provided to Defendants from Plaintiff and/or Plaintiffs agents. WHEREFORE, Plaintiff, Kegel's Produce, Inc., demands judgment against the Defendants in the amount of$10,446.0l, plus interest, attorneys fees, and costs. COUNT II - QUANTUM MERUIT 13. Plaintiff hereby incorporates by reference the averments contained in paragraphs I through 12 as if fully set forth. 14. The Defendants are liable to the Plaintiff and/or have been unjustly enriched in the amount of $10,446.01. WHEREFORE, Plaintiff, Kegel's Produce, Inc., demands judgment against the Defendants in the amount of $ I 0,446.0 I, plus interest, attorneys fees and costs.
