CIVIL ACTION - LAW PRESTON GREENLEE and MYRA CHERRY, Defendants COMPLAINT AND NOW, this 3'd day of February, 2005, comes the Plaintiff, through his undersigned attorneys, and upon causes of action files this Complaint and in support thereof avers as follows: 1. The Plaintiff, Scott Harvey, is an adult individual residing at 6342 N. Powderhorn Road, Mechanicsburg, Cumberland County, Pennsylvania 17055. 2. The Defendant, Preston Greenlee, is an adult individual believed to be residing at 4267 Cuesta Drive, Irving, Texas 75038. 3. The Defendant, Myra Cherry, is an adult individual believed to be residing at 4267 Cuesta Drive, Irving, Texas 75038. 4. In November 2004, Plaintiff found an advertisement offering for sale a 1969 Lincoln Continental Automobile (hereinafter "Automobile") on the e-Bay internet website. 5. The offer seeking to sell this Automobile was placed by Defendants Greenlee and Cherry. 6. The advertisement on e-Bay indicated the Automobile had 21,000 original miles and offered it for sale. 7. Plaintiff after reviewing the advertisement on the e-Bay internet website was able to contact Defendant Greenlee by phone to discuss the condition of the Automobile in November 2004. 8. Defendant Greenlee in a conversation with Plaintiff in an attempt to induce him to purchase this Automobile, represented that the car was in "showroom condition except for one (1) unnoticeable nick" and wanted $15,900.00 to purchase it. 9. Plaintiff, relying on the statements by Defendant Greenlee, agreed to purchase the Automobile for $15,900.00 from the Defendants. 10. Plaintiff forwarded a cashier's check to Defendants in the amount of $15,900.00 on or about November 15, 2004 which was accepted and cashed by Defendants. 11. Defendants then made arrangements to ship the Automobile from Irving, Texas to Mechanicsburg, Pennsylvania at Plaintiff's expense. 12. Transportation was arranged through VIP Transport which was paid by Plaintiff as evidenced on the Bill of Lading signed by Defendant Greenlee on November 26, 2004. See Exhibit "A" attached hereto and made a part hereof. 13. The aforesaid Bill of Lading from VIP Transport indicates numerous nicks, scratches, and other body damages on the Automobile at the time it was shipped from Texas to Pennsylvania as evidenced by the signature of Defendant Greenlee. 14. Upon receipt of the Automobile, Plaintiff discovered more than 40 nicks and scratches on it, plus numerous other deficiencies in the body. 15. Plaintiff sought estimates to repair the damaged body on the Automobile, the lowest of which amounted to $5,131.46. Attached hereto and made a part hereof as Exhibit "B" is an estimate of repair obtained from a body shop by Plaintiff. COUNT I Scott Harvey v. Preston Greenlee and Myra Cherry Breach of Contract 16. Plaintiff incorporates the averments of Paragraphs 1 through 15 above as if fully set forth herein. 17. The parties entered into a contract in November 2004 when Plaintiff agreed to purchase the aforesaid Automobile from Defendants for $15,900.00. 18. Upon entering this agreement, Plaintiff performed his obligations under the contract and paid the consideration agreed by the parties. 19. Defendants breached this contract by shipping an Automobile that contained over 40 nicks and scratches when they represented this vehicle was in "showroom" condition except for one (1) small scratch on the left rear quarter panel. 20. Plaintiff is entitled to recover the cost to repair the Automobile to place it back in "showroom" condition which amounts to $5,131.46. WHEREFORE, Plaintiff demands judgment against Defendants Preston Greenlee and Myra Cherry in the amount of $5,131.46, plus court costs and interest. COUNT II Scott Harvey v. Preston Greenlee and Myra Cherry Fraud 21. Plaintiff incorporates the averments of Paragraphs 1 through 20 above as if fully set forth herein. 22. Defendants Greenlee and Cherry induced Plaintiff to enter into the aforesaid contract to purchase the Automobile by advertising it on the e-Bay internet website and indicating in a phone conversation the Automobile was in "showroom" condition. 23. At the time Defendants shipped the automobile from Texas, as evidenced by the Bill of Lading, the Automobile contained over 40 nicks and scratches which were contrary to their advertisement and the statements by Defendant Greenlee to Plaintiff. 24. Defendants Greenlee and Cherry falsely represented to Plaintiff that the Automobile was in "showroom" condition which induced Plaintiff to purchase it at the offered price. 25. Defendants Greenlee and Cherry intended that Plaintiff would rely upon the aforesaid representations. 26. Plaintiff justifiably relied upon the misrepresentations of Defendants Greenlee and Cherry by entering the contract to purchase the Automobile as stated herein. 27. Plaintiff has suffered damages as a result of the aforesaid misrepresentations in that Plaintiff has incurred a cost of $5,131.46 to repair the Automobile to put it into showroom-like condition. WHEREFORE, Plaintiff demands judgment against Defendants Preston Greenlee and Myra Cherry in the amount of $5,131.46, plus court costs and interest. COUNT III Scott Harvey v. Preston Greenlee and Myra Cherry Unfair Trade Practices and Consumer Protection Law 28. Plaintiff incorporates the averments of Paragraphs 1 through 27 above as if fully set forth herein. 29. By engaging in the above described misrepresentations, Defendants violated the Pennsylvania Unfair Trade Practices and Consumer Protection Law, in particular the following Sections: causing likelihood of confusion or misunderstanding as to the certification of goods; representing that the goods have certain characteristics or qualities that they do not have; representing that the goods are of a particular standard quality or grade if they are of another; and engaging in any other fraudulent conduct which creates a likelihood of confusion or of misunderstanding. 30. Plaintiff reasonably relied upon Defendants deceptive trade practices in determining to purchase the aforesaid Automobile. 31. Pursuant to 73 P.S. ~201-9.2, Plaintiff is entitled to an award up to three (3) times the actual damages as is described above, together with attorney's fees and such additional remedies as the Court deems appropriate. WHEREFORE, Plaintiff demands judgment against Defendants Preston Greenlee and Myra Cherry in the amount of $5,131.46, treble damages for their willful and intentional misrepresentation of material information, and payment of all attorney's fees and costs in pursuit of this action.
