Defendant CIVIL ACTION-LAW IN CUSTOIJY STIPULATION OF lrHE PA~TIES The parties hereto stipulate as follows: 1. They are the parents of Sara E. Shearer bom January 4, 1987, Krystal A. Shearer bom November 26, 198€. and Michael J. Shearer bom April 24, 1991. 2. The parties shall share legal custody of their children. 3. Christina M. Reagan (fonner1y Christina M. Shearer), hereinafter Mother, shall have primary physical custody of Sara E. Shearer and Michael J. Shearer. Heber L. Shearer, herein;~fter Father, shall have primary physical custody of Krystal A. Shearer. 4. The parties will altemate weekends of custody With the children so that the children are together each and eV1'~ry weekend. Weekends shall extend from Friday night at 5:00 p.m. until Sunday evening at 5:00. p.m. during those periods of time when the children are enrolled on Sunday evenings in religious education. When the. children are not enrolled in religious education, Father will pick up the children at 7:00 p.m. instead. Initially, Father will retum the children at 5:00 p.m. and Mother shall provide written notice to Father of the .dates when 'eligious education terminates and the date upon which it commences. The parties will alternate custody e,f the children on the following holidays: a. New Years Day from 9;00 3.m. until 7:00 p.m. b. Easter from 7;00 p.m. on the Saturday preceding the holiday to 7;00 p.m. on Easter Day. c. Memorial Day weekend from 7:00 p.m. on the Friday preceding the holiday to 7;00 p.m. on Men'lorial Day. d. Fourth of July weekend from 7;00 p.m. on the Friday prior to July 4" unl117:00 p.m. on the Sunday after the Fourth of July. e. Labor Day weekend from 7:00 p.m. on the Friday preceding Labor Day until 7:00 p.m. on Labor Day. f. Thanksgiving holiday from :l:OO p.m. on the Wednesday preceding Thanksgiving until 9:00 a.m. on the Saturday after Thanksgiving. On Thanksgiving weekend, the I)arty not enjoying the holiday itself, shall 'have custody of the chilc\rerl from 9:00 a.m. on Saturday until 7:00 p.m. on Sunday. g. Christmas holiday from 7:00 p.m. on December 22 until 12:00 noon on Christmas day. The party not enjoying custody of the children for that period of time on Christmas, shall have custody from noon on Christmas Day until 9:00 a.m. on New Years Day. 6. The parties shall share custody of 'the children over the' summer vacation which shall commence at 7:00 p.m. em the Friday after school is out with the party who enjoys custody ~n that week.e"nd keeping the children until 7:00 p.m. on the following Friday. The exchange of custody anticipated by this Order shall commence on or about January 20, 2005, the concliJsion of the fall semester. 8. Commencing June 2005 neither party shall seek child support one from the other. 9. Both parties agree to be fully responsible for the medical expenses of the children in their primary custody. Nevertheless, Father shall maintain health insurance coverage on the children so long as he is permitted to by the terms of his employer's health insurance plan. 10. Neither party shall be required to .transfer the children pursuant to the terms of this Order if the other party i~; an hour or more late in picking up the children. 11.
