". D~ LAST WILL AND TESTAMENT OF BERTHA I. JOHNSON I, BERTHA I. JOHNSON, of Lower Paxton Township, Dauphin County, Pennsylvania, declare this to be my Last Will and revoke any Will or Codicil previously made by me. ITEM I. I direct that all expenses of my last illness and funeral, including my gravemarker and perpetual care, shall be paid from my residuary estate as soon as practicable after my de- cease as a part of the expense of the administration of my estate. ITEM II. I direct that all taxes that may be assessed in consequence of my death, of whatever nature and by whatever juris- diction imposed, shall be paid from my residuary estate as a part of the expense of the administration of my estate, without appor- tionment. , -'~) ITEM III. I devise and bequeath all of my estate,' of every nature and wherever situate, to my son, EARL H. JOHNSON, II',' providing that he shall survive me by thirty (30) days. eij ITEM IV. Should my son, EARL H. JOHNSON, II, predecease me or die on or before the thirtieth (30th) day following my death, then I devise and bequeath all of my estate, of every nature and wherever situate, to such of his children, KELLI A. JOHNSON and ;7{,,~~ - r-Q. Q_,~ __ {/ EARL H. JOHNSON, III, as are living on the thirty-first (31st) day fOllowing my death. Should my aforesaid son and both of his said children have predeceased me or died on or before the thirtieth (30th) day following my death, then I devise and bequeath all of my estate, of every nature and wherever situate, in equal shares to the South Central Pennsylvania Chapter of the Heart Association and the Dau- phin County Unit of the American Cancer Society. ITEM V. I appoint HAMILTON BANK, of Harrisburg, Dauphin County, Pennsylvania, as the Guardian of any property which passes either under this Will or otherwise to a minor and with respect to which I am authorized to appoint a guardian and have not otherwise specifically done so, provided that this appointment of a guardian shall not supersede the right of any fiduciary in its discretion to distribute a share where possible to the minor or to another for the minor's benefit. Such Guardian shall have the power to use principal as well as income from time to time for the minor's sup- port and education (including college education, both graduate and undergraduate) without regard to his or her parent's ability to provide for such support and education, or to make payments for these purposes, without further responsibility, to the minor or to the minor's parent or to any person taking care of the minor. ~~ cQ.;."~ - 2 - Wherever the word "minor" is used herein, it shall mean any person under the age of twenty-two (22) years. I direct that my Executor or Guardian, or their successors, shall not be required to give bond for the faith- ful performance of their duties in any jurisdiction. ITEM VIII. It is my desire that my Executor shall retain the law firm of MELMAN, GEKAS, NICHOLAS & LIEBERMAN, now of Harris- burg, Pennsylvania, to aid him in the administration of my estate.
