KNOW ALL MEN BY THESE PRESENT,that WHEREAS,John Schaffer,Jr.,late
of Upper Allen Township,Cumberiand County,Pennsylvania,deceased,died testate on May 10, � ,
20�2;
WHEREAS,Letters Testamentary on the estate of the said decedent were duly issued by
the Register of Wills of Cumberland County,Pennsylvania,on June 7,2012 naming Joan E.
Gavigan as Executrix;
W�IEREAS,the Executrix has gathered the assets of the estate of the decedent and the
assets consist of personal property,real estate,and monies,with a total value of$96b,749.18 as
set forth in Exhibit"A",which is a statement of account of said Executrix,and which is attached
hereto and made a part hereof,and marked as Exhibit"A";
� WHEREAS,the debts and deductions,including al!specific bequests and the payment of
inheritance tax on the said estate,paid by the estate amount to$433,260.b9,as set forth on
Exhibit"B"attached hereto;thereby leaving a balance for distribution of$533,488.49 from
which the Executrix will/has:{i)withhold$1,Q20.00 for payment of final a�torney's fees, (ii}
� withhold$1,000.40 for payment of fiduciary taxes and any other proper expenses or tiabilities of
the estate of which the Executrix sha11 have received notice by that time,or which may otherwise
be payable,and(iii)distribute to the beneftciary,in the proportion of their interests and without
furd�er accounting,the balance then remaining of$531,4b8.49 available for distribution,as set
forth in the statement of the said Executrix,which is attached hereto and tabeled >
"Recapitulation". Such distribution will also include any funds received by the Executrix
subsequent to the date to which the attached Account is stated. Should any proper liabilities of
the estate,whether for taxes or otherwise,arise or come to the attention of the Executrix any of
the other parties thereafter,#he beneficiary agree to be jointly and severally liable thereof;
WHEREAS,in accordance with the decedent's Will,the Decedent made the following
bequest which have been met. Indiv�dual Receipt&Releases executed by a11 beneficiaries set
forth in this paragraph:
j. To his friends, William Hosler and Pat Hosler he left his automobile;

2. To his friend,Brian Capriotti he[eft the sum of$I,400.00;
3. To his daughter,Joan E.Gavigan he lef�the sum of$100,000.00;
4. To his granddaughter,Megan"Quinian"Thomas he left the sum of�30,OOO.UU;
5. To his brother,Peter K.Schaffer he left the sum of$50,000.00;
b. To his nephew,Peter K.Schaffer,Jr.he lef�the sum of$25,OOQ.00;
7. To his nephew and wife,John Joseph Schaffer and Claire Schaffcr he Ieft the sum
of$30,000.00;
8. To his nephew,Andrew SchafFer he left the sum of$25,004.00;
9. To his niece,Constance Bockstoce he left the sum of$25,OOO.UO;
l�.To his grandson,Scott C.Ke11y he left the sum of�30,000,00;
11.To St.Michael's Evangelical Lutheran Church of Harrisburg,Pennsylvania he left
the sum of$25,000.00;
12.To his great grandson,Thomas Scott Kelly to be invested by his mother,Molly E.
Kelly he left the sum of$5,000.00 to be placed in a Certificate of Deposit ur other
similar investment until he is 18 years of age;
W��EREAS,in accordance with the decedent's V11i11,the sole beneficiary of the rest,
residue and remainder of the estate is the Children's Miracle Network for the use and benefit of
Penn State Children's Hospital at Hershey,Pennsylvan[a;
WHEREAS,the parties hereto agree that the remaining balance of#he estate assets shall
be distributed as set forth in the Schedule of Distribution,a copy of which is attached hereto as
Exhibit"C"and made a part hereof,�ncluding distribution of all legacies as therein set forth.
Without intending to limit the rights or remedies of the Ex�cutrix,the party further agrees to :
indemnify,to the extent of the distribution made to the undersigned,the Executrix and save her �
harmless against a111iability, loss,and expenses,including,but not limited to,costs and counsel
fees which she may incur,whether due to her negligence or otherwise,as a result of making the
above described distributions without a court audit;
NOW,THEREFURE,that the Children's Miracle Network through the O�ice of Gift
Planning at The Pennsylvania Sta#e University,being the charity entifiled to inherit,does hereby,
acknowledge that they will receive from the aforesaid Executrix upon execution of this
agreement,in full satisfaction aU sum or sums of money, and which amount is in the amount set
opposite their respec#ive name in the table and schedule of distribution in said s#atement at�ached
hereto and marked Exhibit"C";
AND,they do hereby stipulate that in order to avoid the expense and time involved in the
filing of a formal account and schedule of distribution,they agr�e that no account is necessary

and they do hereby agree that they consent to distribution being made without the filing of an �
account and schedule of distribution,the same to be with the same force and effect as if they had
been fifed and confirmed by the Orphans'Court Division of the Court of Common Pleas,
C.umberland County,Pennsylvania.
T�IEREFORE,they do hereby remise,release,quitclaim and forever discharge the said
ExecuNix,her heirs and assigns,of and from the said estate and from all actions,suits,payments,
accounts,reckoning,claims,and demands whatsoever for or by reason thereof,or for any other
use,matter,cause,or thing whatsoever,touching upon the estate of the said decedent,and each
� of us do further hereby covenant and agree that should any iiability come due to the estate of the
said decedent a�ter the signing of this Agreement,they do hereby covenant and agree with the
aforesaid Execu�rix,that they will contribute pro-rata,their share of the estatc to satisfy any and
all claims,demands,suits,or causes of action which may be successfully prosecuted against the
said estate or the aforesaid Executrix after the signing,seaiing and delivery of this Settlement
Agreement and Final Release.
