COMPLAINT
I. Plaintiffs, Dale M. Cox and Janette M. Cox, are adult individuals residing at 1336
Asper Drive, Boiling Springs, Cumberland County, Pennsylvania.
2. Defendant, Shalakemia Moffitt, is an adult individual residing at 8301 Presidents
Drive, Apt. 1022, Hummelstown, Dauphin County, Pennsylvania 17036.
3. On or about June 11,2004, Plaintiffs owned and operated a 1992 Oldsmobile.
4. On the same date, Defendant owned and operated a 1996 Chevrolet Lumina.
5. On the same date, Defendant was driving north on State Road II, Carlisle Pike, in
the right lane.
6. On the same date, Plaintiffs were driving north on State Road II, Carlisle Pike, in
the left lane.
7. On the same date, Defendant made an illegal left-hand turn from the right lane in front
of Plaintiffs' vehicle.
8. On the same date, Defendant caused Plaintiffs to collide into Defendant's vehicle.
COUNT I - Nel!lil!ence
9. Paragraphs 1-8 are incorporated herein by reference.
10. The aforementioned collision was caused as a result of the negligence, recklessness
and carelessness of Defendant in that she, among other things:
a. operated a vehicle in a careless, reckless, and negligent manner;
b. failed to properly operate and control the vehicle;
c. failed to operate the vehicle under the proper control so as to prevent striking
Plaintiffs' vehicle;
d. failed to properly signal her lane change;
e. failed to notice an approaching vehicle;
f. failed to use due care under the circumstances;
g. failed to change lanes with caution;
h. operated the vehicle in disregard of the rules of the road, the ordinances ofthe
local municipality and the laws of the Commonwealth of Pennsylvania,
including, but not limited to, the Motor Vehicle Code.
II. At all times material hereto, Plaintiffs acted with due care and were not contributorily
negligent.
12. As a direct and proximate result of Defendant's negligence, Plaintiffs incurred
damages in the amount of $3,848.97. A copy of the repair estimate and towing invoice are attached
hereto as Exhibit "A."
WHEREFORE, Plaintiffs demand j udgment against Defendant in the amount of$3,848.97,
plus attorneys' fees, costs, interest, and any other relief that the court deems appropriate.
COUNT II - Breach of Contract
13. Paragraphs 1-12 are incorporated herein by reference.
14. Defendant orally agreed to enter into a payment plan and settle the dispute with
Plaintiffs.
IS. Defendant was to make monthly payments to Plaintiffs, by way Plaintiffs' insurer,
in the amount of $200.00 a month.
16. As of this date, Defendant has failed to make any payments under the oral contract.
17. Defendant has informed Plaintiffs that she will not make payments on the plan.
18. Defendant had made an absolute and unequivocal refusal to make payments on the
plan.
19. Defendant has anticipatorily breached her oral agreement.
WHEREFORE, Plaintiffs demand judgment against Defendant in the amount of$3,848.97,
plus attorneys' fees, costs, interest, and any other relief that the court deems appropriate.

recycled parts they must be of like kind and quality or better than
those being replaced.
AUTHORIZATION TO REPAIR: This is not an authorization to repair
Vehicle owner is responsible for authorizing shop to begin repairs.
If vehicle owner is a third party or claimant, the insurance company
should be contacted to confirm liability coverage before authorizing
repairs.
CUSTOMER CHOICE OF SHOPS: Selection of the repair shop is the
responsibility of the vehicle owner. Vehicle owner is under no

AND NOW, comes the Defendant, by her attorneys, Hartman, Osborne & Rettig, P .C.
and Answers Plaintiffs' Complaint as follows
I. It is admitted that the Plaintiffs are who the say they are. As to the balance of the
allegations of this paragraph, after reasonable investigation, Defendant is without knowledge or
information sufficient to form a belief as to the truth thereof and proof is demanded.
2. Admitted.
3. Denied. As to the balance of the allegations of this paragraph, after reasonable
investigation, Defendant is without knowledge or information sufficient to form a belief as to the
truth thereof and proof is demanded.
4. Admitted.
5. Denied. To the contrary, Defendant was driving north on State Route II in the
left lane.
6. Denied as stated. It is admitted, based on information and belief, that the
Plaintiffs were driving north on Route 11. As to the balance of the allegations of this paragraph,
after reasonable investigation, Defendant is without knowledge or information sufficient to form
a belief as to the truth thereof and proof is demanded.
7. Denied. To the contrary, Defendant made a left-hand turn from the left lane,
rather than from the right lane of northbound State Road 11.
8. Denied as stated. It is admitted that the Plaintiffs collided into the Defendant's
vehicle. It is denied that the Defendant cause the Plaintiffs to collide into her vehicle.
COUNT I - NEGLIGENCE
9. The answers to paragraphs 1 through 8 are incorporated herein by reference
thereto.
10. Denied pursuant to Pa. R.C.P. 1029.
11. Denied. This allegation represents a conclusion oflaw to which no reply is
required.
12. Denied. It is denied that the Defendant's negligence caused Plaintiffs any injury.

CAPAno If use of such parts voids the warranty on the part being
replaced or any other part, the aftermarket crash part shall have a
warranty equal to or better than the remainder of the existing
warranty.
QUALITY RECYCLED PARTSjUSED(QUAL RECYCLED PART) :If appraisal specifies
recycled parts they must be of like kind and quality or better than
those being replaced.
AUTHORIZATION TO REPAIR: This is not an authorization to repair
Vehicle owner is responsible for authorizing shop to begin repairs.
If vehicle owner is a third party or claimant, the insurance company
should be contacted to confirm liability coverage before authorizing
repairs.
CUSTOMER CHOICE OF SHOPS: Selection of the repair shop is the
responsibility of the vehicle owner. Vehicle owner is under no
