WHEREAS, ROY J. MCMULLEN and JANE P. MCMULLEN of 1 Charisma Drive, Camp
Hill, Pennsylvania, is about to execute contemporaneously herewith, a contract, with CARLSON
CONSTRUCTION, INC. of 1208 Summit Way, Mechanicsburg, Pennsylvania, for the erection of a
building upon premises commonly known as LOT F-ll COUNTRY CLUB ROAD, Township EAST
PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth in the deed dated October 6,2004,
recorded at Deed Book 265, Page 3258, in the Recorder's Office for CUMBERLAND County,
Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached
hereto.
NOW, December 20, 2004, at the time of and immediately before the execution of the principal
contract, and before any authority has been given by the said Owner to the said Contractor to commence
work on the said building, or purchase materials for the same in consideration of the making of the said
contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner,
it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra
labor or materials purchased for the erection of said building, the right to file such liens being expressly
waived.

ALL THAT CERTAIN tract or parcel ofland situate in East Pennsboro Township, Cumberland
County, Pennsylvania, bounded and described as follows, to wit:
BEGINNING at an iron pin in the southerly right-of-way line of Country Club Road, said point
being a common comer of Lot F-11 and Lot F-1O; thence along Lot F-10, South 50 degrees 45 minutes
00 seconds West, a distance of 151.22 feet to an iron pin; thence along existing land for future
development of Floribunda Heights, North 39 degrees 15 minutes 00 seconds West, a distance of 110.00
feet to an iron pin; thence along the southerly right-of-way line of Europeana Court, North 50 degrees
45 minutes 00 seconds East, a distance of 122.05 feet to a point; thence leaving the southerly right-of-
way line of Europeana Court on a curve to the right having a radius of 20.00 feet, an arc of 29.41 feet
and a chord bearing South 87 degrees 07 minutes 30 seconds East, a distance of26.83 feet to a point in
the southerly right-of-way line of Country Club Road; thence along the southerly right-of-way line of
Country Club Road, South 45 degrees 00 minutes 00 seconds East, a distance of 92.47 feet to an iron pin,
said point being the point and place of BEGINNING.
CONTAINING .356 acres.
BEING Lot F-11 as shown on a subdivision plan entitled "Pealer Land Development" , Phase I,
recorded in the Cumberland County Recorder of Deeds Office in Plan Book 46, Page 4.
UNDER AND SUBJECT, NEVERTHELESS, to all easements, restrictions, encumbrances and
other matters of record or that which a physical inspection or survey of the premises would reveal.
