STIPULATION AGAINST LIENS

THIS AGREEMENT made this ~G day of December, 2004, by and
between Neidlinger Constructio~a sole proprietor, hereinafter
referred to as Contractor,
AND
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West Pennsboro Township, Cumberland County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#34 Kerrsville Road, Carlisle, PA 17013.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
bui ldings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or parcel of ground, together with any improvements
thereon erected, situate in West Pennsboro Township, Cumberland County,
Pennsylvania, bounded and described pursuant to the Final Subdivision Plan for Robert J.
Yinger, Barry L. Yinger, and Glenn L. Warehime, as prepared by John K. Bixler, III,
P.L.S. dated May 8,1992, and recorded in the Recorder of Deeds Office in and for
Cumberland County, in Plan Book 63, Page 42, as follows:
BEGINNING at a PK nail set in Township Route 326 (Kerrsville Road) at comers
common with Lot No. 35 of the within referenced subdivision plan; thence in said
Township Route South 12 degrees 04 minutes 54 seconds East along an arc having a
radius of215.84 feet a distance of 127.35 feet to an existing PK nail; thence in same
South 28 degrees 59 minutes 05 seconds East a distance of 40.40 feet to an existing PK
nail; thence in same South 33 degrees 31 minutes 05 seconds East a distance of 41. 91 feet
to an existing PK nail; thence along lands now or formerly of Steven J. Harner South 82
degrees 27 minutes 30 seconds West a distance of 597.14 feet through an existing iron
pin to an iron pin set at comers common with Lot No. 33 ofthe within referenced
subdivision plan; thence along said Lot No. 33 North 17 degrees 00 minutes 24 seconds
West a distance of251.22 feet to an iron pin set at comers common with Lot No. 35 of
the within referenced subdivision plan; thence along said Lot No. 35 North 86 degrees 48
minutes 28 seconds East a distance of 625.00 feet through an iron pin to a PK nail set in
Township Route 326 (Kerrsville Road), being the Place ofBEGlNNING.
BEING all of Lot No. 34 of the aforementioned subdivision plan.
CONTAINING 3.129 acres.
