STIPULATION AGAINST LIENS
THIS AGREEMENT made this JL day of December, 2004, by and
between Neidlinger Construction, a s01e proprietor, hereinafter
referred to as Contractor,
AND
Larry V. Neidlinger and Mary Jo Neidlinger, husband and wife,
hereinafter referred to as Owners, whereby the contractor undertook
and agreed to erected and construct a dwelling on the certain lot
of ground situate in West pennsboro Township, Cumber1and County,
Commonwealth of Pennsylvania, and more fully described in Exhibit
"A" which is attached hereto and made a part hereof known as Lot
#15 Crossroads Scho01 Road, Newvi11e, PA 17241.
NOW THEREFORE, THIS AGREEMENT WITNESSETH: That the said
Contractor, for an in consideration of the sum of ($1.00) Dollar to
Contractor in hand paid by Owner, the receipt whereof is hereby
acknowledged, and the further consideration mentioned in the
agreement aforesaid, for itself, himself or themselves and its, his
or their subcontractors, and all parties acting through or under
them, covenant and agree that no mechanic's liens or claims shall
be filed or maintained by them or any of them against the said
buildings and the lot of ground appurtenant thereto for or on
account of any work done or materials furnished by them or any of
them under said contract or otherwise, for, towards, in, or about
the erection and construction of the said buildings on the lot
above described, and the said Contractor, for itself, himself or
themselves, its, his or their subcontractors and others under them,
hereby expressly waive and relinquish the right to have, file, and
maintain any mechanic's liens or claims against the said buildings
or any of them, and agree that this instrument, waiving the right
of lien, shall be an independent covenant.

ALL THAT CERTAIN tract or lot of land lying and being situate in West
Pennsboro Township, Cumberland County, Pennsylvania, being bounded
and described as follows:
BEGINNING at a Parker Kalon Nail (set) on the centerline of T-438 also
known as Crossroad School Road at the dividing line of Lot No. 15 herein
conveyed and lot No. 16 as shown on the hereinafter mentioned
Subdivision Plan; thence along said centerline of T-438, also known as
Crossroad School Road, South 50 degrees 16 minutes 24 seconds East, a
distance of 220.00 feet to a Parker Kalon Nail (set) at the dividing line of
Lot No. 14; thence along Lot No. 14 passing through an iron pin 23.53 feet
from beginning point, South 39 degrees 43 minutes 36 seconds West a
distance of 390.00 feet to an iron pin; thence North 81 degrees 01 minutes
54 seconds West, a distance of 142.74 feet to a concrete monument at
the dividing line of Lot 20; thence along Lot 20 North 50 degrees 16
minutes 24 seconds West, a distance of 97.34 feet to an iron pin at the
dividing line of aforementioned Lot No. 16; thence along Lot No. 16 North
39 degrees 43 minutes 36 seconds East, a distance of 463.00 feet passing
through a drainage easement and an iron pin 23.11 feet from end point
to a Parker Kalon Nail (set) the Place of BEGINNING.
CONTAINING an area of 2.23560 acres and a net area of 2.11839 acres
excluding the dedicated right of way of T-437, also known as Cross Road
School Road.
SUBJECT to a drainage easement area of 0.01806 acre in the Northeast
corner of Lot as shown on Plan.
BEING Lot No. 15 as shown on the Land Subdivision for Stonecrest Acres
prepared by Carl D. Bert, Professional Land Surveyor, dated December 23,
1999, and recorded in the Recorder of Deeds, Cumberland County, in
Plan Book 8 L Page 124.
