This instrument is executed this .J:. day of December, 2004, by Stoudt Constmction
("Contractor") (or "Subcontractor''') in favor of Kenneth R. Walters ("Owners")
Whereas, Owners are about to execute contemporaneously herewith, a contract with Contractor for
the erection of a Lincoln Log Home upon a lot of land situate in North Newton Township,
Cumberland County, Pennsylvania, being known as Lot No. 30 Greenspring-Road, bounded and
described in accordance with a Plan prepared by Rodney Lee Decker, R.P.L.S., dated June 8,1999
as recorded in Cumberland County Plan Book 58, Page 109, more fully described as follows:
BEGINNING at a point in northern right of way line ofPA Route 641, at comer of
Lot NO.3 I on said plan; thence along Lot No.3 I North 16 degrees 56 minutes 45
seconds East 567.53 feet to a point at Lot No.3 I; thence along Lot No. 31 South 68
degrees 14 minutes 50 seconds East 152.42 feet to a point; thence along Lot No. 29
South 04 degrees 36 minutes 10 seconds West 527.92 feet to a point; thence along
northern right of way of Pa Route 641 by a curve to the right having a radius of
1940.00 and arc distance of267.82 feet on a chord bearing of North 81 degrees 26
minutes 35 seconds West to a point, the Place of BEGINNING.
CONTAINING 2.626 acres and designated as Lot 30 of North Newton Manor.
BEING part of the same premises which Orvel W. Baer and Pauline E. Baer, his wife,
granted and conveyed unto to Kimba, Inc., et aI, Grantors herein, by deed dated August 7,1989 and
recorded in the Office of the Recorder of Deeds for Cumberland County in Deed Book C, Volume
34, Page 227.
Now, , at the time of and immediately before the execution of the constmction
contract aforesaid, and before any authority has been given by the said Owners to the said Contractor
to commence work on the said building, or purchase materials for the same, in consideration ofthe
Owners making of the said contract with Contractor, and intending to be legally bound hereby, it
is agreed that no lien shall be filed against the building by Contractor, or any sub-contractor, nor by
any of the materialmen or workmen or any other person for any labor, or materials purchased, or
extra labor or materials purchased for the erection of said building, the right to file such liens being
expressly waived.
