STIPULATION AGAINST MECHANICS' LIENS
WHEREAS, David M. Manganello and Kimberly C. Manganello, of25 Wild Rose Lane,
Mechanicsburg, Pennsylvania entered into a contract with D Cully, Inc. T/DIB/A C&C
Construction, Contractor, of 5745 Spring Road, Shermans Dale, Pennsylvania 17090 to provide
materials and perform labor necessary for the construction of a residence, upon the following tract
of land located in Silver Spring Township, Cumberland County, Pennsylvania, more specifically
described as follows, to wit:
ALL that certain tract or parcel of land situate in the Township of Silver Springs, County of
Cumberland and Commonwealth of Pennsylvania, more particularly bounded and described as
follows, to wit:
BEGINNING at a point at comer of lands now or formerly of C.M. Dubs and the southwestern
comer of Lot No. 34 of Samples Bridge Estates; thence South 5 degrees 15 minutes East, a
distance of two hundred four (204) feet to a point; thence South 4 degrees West, a distance of
seventy-four and twenty-five hundredths (74.25) feet to a point; thence South 18 degrees 15
minutes West, a distance of one hundred twenty-three and seventy-five hundredths (123.75) feet
to a point; thence South 33 degrees West, a distance of two hundred forty-four and twenty
hundredths (244.20) feet to a point; thence South 62 degrees East, a distance of sixty-two and
seventy hundredths (62.70) feet to a point; thence South 31 degrees 15 minutes West, a distance
of four hundred thirty-five and seventy-five hundredths (435.75) feet to a point; thence South 40
degrees West, a distance of two hundred sixty four (264) feet to a point; thence South 27 degrees
West, a distance of two hundred fifty-five and seventy-five hundredths (255.75) feet to a point;
thence South 27 degrees 30 minutes West, a distance of sixty-two and twenty-three hundredths
(62.23) feet to a point; thence South 27 degrees 30 minutes West, a distance of three hundred two
and forty-seven hundredths (302.47) feet, more or less, to a point in the center line of the
northbound lane of Interstate Highway 81; thence through the said center line, North 84 degrees
35 minutes West, a distance of one hundred ninety-five and three tenths (195.3) feet, more or
less, to a point; thence North 29 degrees East along lands now or formerly of C.M. Dubs, a
distance of one thousand nine hundred ninety-two and three tenths (1,992.3) feet, more or less, to
the point and place of BEGINNING.
HAVING a total of 7.31 acres and being the same as shown on a survey by Hartman & Assoc.,
dated July 10, 1990, as herein shown.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the said parties as
part of the said contract and for the consideration therein set forth, that neither the undersigned
contractor, any sub-contractor or matcrial man, nor any other person furnishing labor or materials to
the said contractor under thi s contract shall file a lien, commonly called a mechanics' lien for work
done or materials furnished to the said building or any part thereof.
This Stipulation is made and intended to be filed with the Cumberland County Prothonotary
within ten days after date, in accordance with the requirements of Act of Assembly of Pennsylvania,
in such case provided.
IN WITNESS WHEREOF, the said parties hereto have hereunto set their hands and seals
this 1?f4 day of January, 2005.
