CIVIL ACTION/MORTGAGE FORECLOSURE
I. Plaintiff is Household Finance Consumer Discount Company, a corporation duly organized
under the laws of Pennsylvania and doing business at the above captioned address.
2. The Defendant is Sally R. Quigley, who is the mortgagor of the mortgaged property
hereinafter described, and her last-known address is 1520 Lorenzo Street, #B, Mount Pleasant, SC 29464.
3. The Defendant is Gnanachandra M. Chinnah, who is the real owner of the mortgaged
property hereinafter described, and her last-known address is 1017 Walnut Street, Lemoyne, PA 17043.
4. On 06/17/2000, Sally R. Quigley made, executed and delivered a mortgage upon the
premises hereinafter described to MBNA Consumer Discount Services, Inc. which mortgage is recorded in
the Office of the Recorder of Cumberland County in Mortgage Book 1619, Page 892.
5. On 10/03/2000, the aforesaid mortgage was thereafter assigned by MBNA Consumer
Discount Services, Inc. to Household Realty Corporation by Assignment of Mortgage recorded in the Office
ofthe Recorder of Cumberland County in Assignment of Mortgage Book 656, page 351.
6. On 05/! 7/200 I, the aforesaid mortgage was further assigned by Household Realty
Corporation to Household Finance Consumer Discount Company, Plaintiff herein, by Assignment of
Mortgage recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgage Book
675, page 88.
7. On 09/23/2004, the mortgaged premises were sold at an Upset Tax Sale to Defendant,
Gnanachandra M. Chinnah. Title vested to Gnanachandra M. Chinnah by deed from Tax Claim Bureau of
the County ofCumber]and dated I I/! 2/2004 and recorded I2/!/2004 in the County of Cumberland in Record
Book 266, page 2489.
8. The premises subject to said mortgage is described in the mortgage attached as Exhibit "A"
and is known 1017 Walnut Street, Lemoyne, PA 17043.
9. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 10/22/2003 and each month thereafter are due and unpaid, and by the terms of said mortgage,
upon default in such payments for a period of one month, the entire principal balance and all interest due
thereon are collectible forthwith,

11. The attomey's fees set forth above are in conformity with the mortgage documents and
Pennsylvania Law and will be collected in the event of a third party purchaser at Sherin's Sale. If the
mortgage is reinstated prior to the Sale, reasonable attomey's fees will be charged based on work actually
performed.
12. Notice ofIntention to Foreclose as required by Act 6 of 1974 (41 P.S. S403) and notice
required by the Emergency Mortgage Assistance Act of 1983 as amended under 12 PA Code Chapter 13, et
seq., commonly known as the Combined Notice of Delinquency has been sent to Defendants by regular mail
with a certificate of mailing and by certified mail, return receipt requested.
WHEREFORE, Plaintiff demands Judgment against the Defendants in the sum of $90,761.23,
together with interest at the rate of $26.44 per diem and other costs and charges collectible under the
mortgage and for the foreclosure and sale ofthe mortgaged property.

I. Payment .of Principal and Interest at Variable Rates. This mortgage secures all payments of principal and
interest due on a' variable rate loan. The contract fate of interest and payment amounts may be subject to change as
provided in the Note. Borrowers shall promptly pay when due all amounts required by the Note.
2. Funds far Taxes and Insurance. Subject to applicable law or waiver by Lender, Borrower shall pay to Lender
on the"day monthly payments of principal and interest are payable under the Note, until the Note is paid in full, a sum

the Note and this Mortgage unless Lender releases Borrower in writing.
If Lender does not agree to such sale or transfer, Lender may declare.ll of the sums secured by this Mortgage to be
immediately due and payable. If Lender exercises such option to accelerate, Lender shall mail Borrower notice of
acceleration in accordance with paragraph 12 hereof. Such notice shal! provide a period of not less than 30 days from the
date the notice is mailed or delivered within which Borrower may pay the sums declared due. If Borrower lails to pay such
sums prior to the expiration of such period, Lender may, without further notice or demand on Borrower. invoke any
remedies permitted by paragraph 17 hereof.

PRELIMINARY OBJECTION OF DEFENDANT CHINNIAH
TO PLAINTIFF'S COMPLAINT
AND NOW this 12'h day of April, 2005, comes the Defendant, GNANACHANDRA M.
CHINNIAH, by and through his attorneys, Irwin & McKnight, and make the following
Preliminary Objection to Plaintiff's Complaint, and in support thereof avers the following:
I. Preliminary Objection for Improper Service of a Writ of Summons or Complaint
Pursuant to Pa. R. Civ. P. 102S(a)(1).
1. Plaintiff, Household Finance Consumer Discount Company, filed a Civil
Action/Mortgage Foreclosure (hereinafter the "Complaint") on or about February 10, 2005,
commencing the instant action.
2. Plaintiff seeks to foreclose upon the property located at 1017 Walnut Street,
Lemoyne, Cumberland County, Pennsylvania (hereinafter the "Property").
3. Defendant Gnanachandra M. Chinniah is named as a party to this action as a
result of his purchase of the Property at a Cumberland County Upset Sale held on September 23,
2004.
4. The deed from the Cumberland County Tax Claim Bureau was duly recorded in
the Cumberland County Recorder of Deeds in Deed Book 266, Page 2489.

5. Pa.R.C.P. Rule 410 (a) provides that original process in actions involving liens
upon real property shall be served in accordance with Rule 400 et seq.
6. Pa.R.c.P. Rule 400 (a) provides that original process shall be served within the
Commonwealth of Pennsylvania by the sheriff, with certain exceptions not applicable in this
matter.
7. Pa.R.c.P. Rule 401 (a) provides that original process shall be served within the
Commonwealth within thirty (30) days from the filing of the complaint.
8. Defendant Chinniah was served by sheriff with the Complaint on March 23, 2005,
which time is more than thirty (30) days from the date of filing.
9. Plaintiff did not seek to reinstate the Complaint as provided in Rule 40 1.
10. Because of the failure of Plaintiff to serve the Complaint in accordance with the
above-stated Rules of Civil Procedure, Defendant Chinniah preliminarily objects to the service
of the Complaint in accordance with Rule 1028 (a)(I).
WHEREFORE, Defendant Gnanchandra M. Chinniah respectfully requests this
Honorable Court to dismiss Plaintiffs Complaint.

And now, comes the Plaintiff, Household Finance Consumer Discount Company ("Household" , by
and through its counsel of record, McCabe, Weisberg & Conway, in response to the Preliminary Objec ions
filed by the Defendant, Gnanachandra M, Chinniah, to aver as follows:

Therefore service of the Complaint on March 23, 2005 was proper service in accordance with Pa.R.Ci .P
401(b)(1). A true and correct copy of the reinstated Complaint is attached hereto as Exhibit "A."
(marked reinstated on the back of the last page of the Complaint)

10. Denied. Specifically, Plaintiff served its Complaint in accordance with the Rules of

6. On 05/17/2001, the aforesaid mortgage was further assigned by Household ealty
Corporation to Household Finance Consumer Discount Company, Plaintiff herein, by Assign
Mortgage recorded in the Office of the Recorder of Cumberland County in Assignment of Mortgag Book
675, page 88.
7. On 09/23/2004, the mortgaged premises were sold at an Upset Tax Sale to De~ ndant,
Gnanachandra M. Chinnah. Title vested to Gnanachandra M. Chinnah by deed from Tax Claim B
the County of Cumberland dated 11/12/2004 and recorded 12/1/2004 in the County of Cumberland in ecord
Book 266, page 2489.
8. The premises subject to said mortgage is described in the mortgage attached as Exh bit" A"
and is known 1017 Walnut Street, Lemoyne, PA 17043.
9. The mortgage is in default because monthly payments of principal and interest u
mortgage due 10/22/2003 and each month thereafter are due and unpaid, and by the terms of said m rtgage,
upon default in such payments for a period of one month, the entire principal balance and all int
thereon are collectible forthwith.

MEMORANDUM OF LAW IN SUPPORT OF PLAINTIFF'S RESPONSE TO DEFENDAN 'S
PRELIMINARY OBJECTIONS TO PLAINTIFF'S COMPLAINT
Pennsylvania Rule of Civil Procedure Rule 1028 (a) provides:
Preliminary Objections may be filed by any
party to any pleading and are limited to the following
grounds:
(1) lack of jurisdiction over the subject matter
of the action or the person of the defendant, improper
venue or improper form of service of a writ of summons
or a complaint;
(2) failure of a pleading to conform to law or
rule of court or inclusion of scandalous or impertinent
matter;
(3) insufficient specificity in a pleading;
(4) legal insufficiency ofa pleading (demurrer);
(5) lack of capacity to sue, nonjoinder of a
necessary party or misjoinder of a cause of action; and
(6) pendency of a prior action or agreement for
alternative dispute resolution.
The Preliminary Objections raised by the Defendant herein do not comport with the Rules f
Civil Procedure in that they fail to set forth any of the aforementioned grounds under which Prelim nary
Objections may be granted.
First, Defendant alleges that Plaintiffs mortgage foreclosure Complaint must be dismissed
-
because the service of the Complaint was improper, alleging that the Complaint had expired when serv ce
was made on the Defendant. This allegation is wrong, and the filing of these preliminary objections is
frivolous. A check of the Cumberland County Court docket reflects that the Plaintiffs Complaint was
reinstated on March 18, 2005 in accordance with Pa.R.Civ.P 401 (b)( 1), which in relevant part states:
If service within the Commonwealth is not made within
the prescribed time by subdivision (a) of this rule. . .
the prothonotary upon praecipe and upon presentation
of the original process, shall continue its validity by
reissuing the writ or reinstating the complaint, by writing
thereon "reissued" in the case of a writ or "reinstated"
in the case of the complaint.

Therefore, Defendant's Preliminary Objections should be dismissed.
