COMPLAINT IN CIVIL ACTION
1. Plaintiff, VOLVO COMMERCIAL CREDIT CORP (hereinafter
"plaintiff") is a corporation with offices in Salt Lake, Utah.
2. Defendant, ANDREW SNELL is an adult individual trading as ANDREW
SNELL CONCRETE CONSTRUCTION (hereinafter "defendant") with a last known
address of 30 Umberto Street, Cumberland County, Pennsylvania 17070.
3. On or about September 4, 2001 defendant submitted a credit
application with plaintiff in order to open a line of credit with plaintiff. A true and correct
copy of the credit application is attached hereto, made a part hereof and marked as
Exhibit "1".
4. After receiving the aforementioned credit application, plaintiff, at the
request of defendant, opened a credit line for defendant which defendant used to make
a series of purchases at the times and in the amounts as set forth on plaintiffs
statement of defendant's account, a true and correct copy of which is attached hereto,
made a part hereof and marked as Exhibit "2".
5. After all payments have been credited, an outstanding balance due in
the amount of $8,708.24 remains due plaintiff from defendant as set forth on Exhibit
"2", but defendant has failed or refused to pay the same or any part thereof despite
repeated demands.
6. In addition to outstanding principal, plaintiff is entitled to interest at a
rate of 6.9% per annum from an average due date of January 1, 2003.
WHEREFORE, plaintiff requests judgment in its favor and against the defendant
in the principal sum of $8,708.24 plus interest at a rate of 6.9% per annum thereon from
January 1, 2003 together with costs.
