Contractor ~ 65'- 1 G,~ fULl) WHEREAS, B.C.R.E. Partners. of 44 State Road, Mechanicsburg, Pennsylvania, 17050, is about to enter into a contract with R. S. Mowery & Sons, Inc., of Mechanicsburg, Pennsylvania, for the construction of a tenant fit-out located at Suite 3 - Bent Creek Gateway Condominium, 3 Baden Powell Lane, Silver Spring Township, Mechanicsburg, Cumberland County, Pennsylvania. NOW. February 10, 2005, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said B.C.R.E. Partners to the said R. S. Mowery & Sons, Inc., to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with R. S. Mowery & Sons, Inc., and the further consideration of One Dollar to R. S. Mowery & Sons, Inc., paid by B.C.R.E. Partners, it is agreed that no lien shall be filed against the building or property by the contractor, nor any , subcontractor, nor by any of the material men or workmen nor any other person for any labor, or materials purchased, or extra labor or materials purchased for the completion of said building, the right to file such liens being expressly waived.
