CLEVELAND, t/d/b/a R. CLEVELAND SERVICES, Contractor WHEREAS, GLADYS E. CLEVELAND of 104 Shirey Court, Gilbertsville, Pennsylvania, is about to execute contemporaneously herewith, a contract, with ROSS M. CLEVELAND, t/d/b/a R. CLEVELAND SERVICES of 4104 Clubhouse Drive, Mechanicsburg, Pennsylvania, for the erection of a building upon premises commonly known as 120 EAST SHADY LANE, LOT 1, Township EAST PENNSBORO, CUMBERLAND County, Pennsylvania, as set forth in the deed dated February 9, 2005, recorded at Deed Book , Page , in the Recorder's Office for CUMBERLAND County, Pennsylvania, as more specifically described in Exhibit "A" which is incorporated herein and attached hereto. NOW, February 9, 2005, at the time of and immediately before the execution of the principal contract, and before any authority has been given by the said Owner to the said Contractor to commence work on the said building, or purchase materials for the same in consideration of the making of the said contract with Contractor and the further consideration of One Dollar ($1.00), to Contractor paid by Owner, it is agreed that no lien shall be filed against the building by the Contractor, or any subcontractor, nor by any of the materialmen or workmen or any other person for any labor, or materials purchased, or extra labor or materials purchased for the erection of said building, the right to file such liens being expressly waived. CLEVELAND SERVICES By: (K~ ;tlt CiWt!flAA[2 (--~"'......\ \ \ \ ./ '. .,"" , Exhibit "A" ALL THAT CERTAIN tract of land situate in the Township of East Pennsboro, County of Cumberland and Commonwealth of Pennsylvania, bounded and described as follows, to wit: BEGINNING at an iron pin located 136.00 feet south of the southern right-of-way of Shady Lane (T -1 0 17), said pin also being the common corner of lands now or formerly of Cletus and Evelyn Miller, Ross and Joy Cleveland, Charles and Beulah Sheaffer, and Donald and Diana Zulli; thence from said point of beginning along lands now or formerly of Cletus and Evelyn Miller, North 14 degrees 56 minutes 30 seconds West a distance of 136.00 feet through a concrete monument to be set 5.00 feet south of the southern right-of-way of Shady Lane; thence along the southern right-of-way North 75 degrees 07 minutes 00 seconds East a distance of 32. 19 feet to a point; thence from said point along Lot #2 of the below referenced subdivision North 14 degrees 56 minutes 30 seconds West a distance of 136.00 feet to a point; thence along lands now or formerly of Charles and Beulah Sheaffer South 75 degrees 07 minutes 00 seconds West a distance of 32.19 feet to the point and place of BEGINNING. CONTAINING 4,377.8 square feet or 0.1005 acres.
