3. On 02/24/2003 mortgagor(s) made, executed and delivered a mortgage upon the premises
hereinafter described to AMERICAN HOME BANK, N.A. which mortgage is recorded
in the Office of the Recorder of CUMBERLAND County, in Mortgage Book: 1798,
Page: 1156. By Assignment of Mortgage recorded 12/12/03 the mortgage was Assigned
To PLAINTIFF which Assignment is recorded in Assignment Of Mortgage Book No.
704, Page 3410.
4. The premises subject to said mortgage is described as attached.
5. The mortgage is in default because monthly payments of principal and interest upon said
mortgage due 10/0112004 and each month thereafter are due and unpaid, and by the terms
of said mortgage, upon failure of mortgagor to make such payments after a date specified
by written notice sent to Mortgagor, the entire principal balance and a1\ interest due
thereon are co1\ectib1e forthwith.

7. The attorney's fees set forth above are in conformity with the mortgage documents and
Pennsylvania law, and will be collected in the event of a third party purchaser at Sheriff's
Sale. If the Mortgage is reinstated prior to the Sale, reasonable attorney's fees will be
charged.
8. Notice of Intention to Foreclose as set forth in Act 6 of 1974, Notice of Homeowner's
Emergency Assistance Program pursuant to Act 91 of 1983, as amended in 1998, and/or
Notice of Default as required by the mortgage document, as applicable, have been sent to
the Defendant(s) on the date(s) set forth thereon, and the temporary stay as provided by
said notice has terminated because Defendant(s) haslhave failed to meet with the Plaintiff
or an authorized consumer credit counseling agency, or haslhave been denied assistance
by the Pennsylvania Housing Finance Agency.
9. This action does not come under Act 6 of 1974 because the original mortgage amount
exceeds $50,000.
WHEREFORE, PLAINTIFF demands an in rem Judgment against the Defendant(s) in the sum of
$ 144,466.17, together with interest from 02/23/2005 at the rate of $22.89 per diem to the date of
Judgment, and other costs and charges collectible under the mortgage and for the foreclosure and
sale of the mortgaged property.

TO PLAINTIFF'S COMPLAINT
AND NOW this 8TH day of April, 2005, comes the Defendant, Jeffrey L. Myers, by and
through his attorneys, Irwin & McKnight, and respectfully file this Answer with New Matter to
the Plaintiff's Complaint, and in support thereof aver as follows:
I. The averments of fact contained in paragraph one (I) of the Plaintiff's Complaint
are admitted.
2. The averments of fact contained in paragraph two (2) with respect to Defendant
Jeffrey L. Myers are admitted.
3. The recorded mortgage and assignment referenced in paragraph three (3) speak
for themselves and therefore no response is required.
4. The averments of fact contained in paragraph four (4) are admitted.
5. After reasonable investigation, Defendant Jeffrey L. Myers is without knowledge
or information sufficient to form a belief as to the truth of the averments contained in paragraph
five (5) so they are therefore specifically denied and strict proof thereof is demanded at trial.
6. After reasonable investigation, Defendant Jeffrey L. Myers is without knowledge
or information sufficient to form a belief as to the truth of the averments contained in paragraph
six (6) so they are therefore specifically denied and strict proof thereof is demanded at trial.
7. The averments of fact contained in paragraph seven (7) are conclusions of law to
which no response is required.
8. The averments of fact contained in paragraph eight (8) are conclusions of law to
which no response is required.
9. The averments of fact contained in paragraph nine (9) are conclusions of law to
which no response is required.
WHEREFORE, Defendant Jeffrey L. Myers respectfully requests this Honorable Court
to enter a judgment in his favor and against Plaintiff in this matter.
NEW MATTER
10. The averments of fact contained in the Answers to the Complaint are hereby
incorporated by reference and are made part of this New Matter to the Plaintiff s Complaint.
11. The property referenced in this matter at 2625 Enola Road, Carlisle, Pennsylvania
has been listed for sale with Wolfe & Shearer Realtors.
12. On March 25, 2005, an Agreement for Sale of Real Estate was signed by the
Defendants for the sale of the property mentioned above. A true and correct copy of the
Agreement for Sale is attached hereto and marked as Exhibit "A".
13. In accordance with Exhibit "A," the agreed upon sales price of the real estate is
$225,000.00, which amount is in excess of the Plaintiff's mortgage in this matter.
14. Settlement is to be held on or before June 10, 2005, at which time the existing
mortgage and any other liens will be paid,

WHEREFORE, Defendant Jeffrey L. Myers, respectfully requests this Honorable Court
to enter judgment in his favor and against Plaintiff in this matter, or in the alternative to delay
further proceedings in this matter until the property is sold and Plaintiff's mortgage is paid.

10. Plaintiff incorporates herein by reference the averments of paragraphs one (1) through nine
(9) of its Complaint as if set forth herein at length.
11, Denied. Plaintiff is without information sufficient to form a belief as to the truth of the
~verments contained in paragraph eleven (11).
12-14. Denied. The averments in paragraphs twelve (12) through fourteen (14) refer to a
document in writing and no characterization thereof is required. By way of further response, an agreement
of sale does not stay the foreclosure action. Until any settlement is consummated, Plaintiff can properly
proceed with the litigation.
