Motion for Transportation of Respondent bv Sheriff Petitioner, Frances E. Freet, by her attorney respectfully represents as follows: .. \...!: 1. A hearing in the above captioned action is scheduled before the Hon. Edgar B. Bayley for 3:00 PM on this day, Monday, February 28, 2005 in Court Room #2 of the Cumberland County Court House, Carlisle, PA. 2. The alleged incapacitated person, Benjamin Long Freet, is committed to the Holy Spirit Hospital Behavioral Health Center under ~ 404 of the PA Mental Health Procedures Act, and he is therefore in custody of the Hospital personnel. 3. Holy Spirit Hospital policies require that a person who is court committed to treatment at the hospital can only be moved to a hearing at the Court House by the Sheriff of Cumberland County. 4. In order for Benjamin Long Freet to be present at the hearing where his capacity will be adjudicated, an order is needed for the Cumberland County Sheriff to provide transportation for Benjamin Long Freet from Holy Spirit Hospital to the Court House and back to Holy Spirit Hospital after the hearing. 5. Michael Jerominsky, Esq., appointed counsel for Ben Long Freet concurs in this petition so that Ben Long Freet can be at the hearing, but notes that Ben Long Freet will likely need a wheelchair in the Court House. WHEREFORE, Petitioner requests this Honorable Court to order the Cumberland County Sheriff to transport Benjamin Long Freet from Holy Spirit Hospital to the Cumberland County Court House for the hearing today at 3 :00 PM, and to transport him back to Holy Spirit Hospital after the hearing. lor .
