Now comes Susan Mease, mother of the deceased, and an adult and hereby applies for
Letters of Administration for the purpose of commencing and prosecuting a civil action for the
wrongful death of the deceased and for administration of the deceased's estate and in support
hereof says the following:
1. She is the mother of the deceased.
2. At the time of the deceased's death he was domiciled in the County of Cumberland,
Pennsylvania, with his principal residence at 1110 Cocklin Street, Mechanicsburg.
3. The deceased died on January 23,2000, as a result of a gunshot wound inflicted on that
date.

4. The deceased was born on July 9,1986, and was fourteen (14) years of age on the date of
his death.
5. The deceased left no property to be administered pursuant to this estate at the time of his
death.
6. The deceased was survived by the following heirs:

7. A previous petition was filed with the Cumberland County Register of Wills for the grant
of letters to Susan Mease.
8. The father of the deceased, Thomas Barton, had been requested to sign a Renunciation,
but refused and has indicated his opposition to the grant of Letters to petitioner.
9. The father of the deceased has had little or no contact with the deceased during his
lifetime and, therefore, has little genuine interest in the administration of this estate.
10. The deceased has lived with his mother during his entire lifetime and had no real
relationship with his father.
11. The grant of letters is necessary so that a civil action for damages may be commenced
against Kenneth Borwegen, Carolyn Borwegen, and James Borwegen, for negligence
resulting in the death of David Colebaugh, a minor.

12. That action will be commenced in the County of Cumberland, Pennsylvania.
13. The petitioner has significant contacts with the County of Cumberland and would act as
plaintiff and representative of the deceased in said action.
14. Petitioner would be represented by the undersigned in the commencement and prosecution
of said action.
15. A hearing is necessary to determine the administrator of the estate, to grant letters, and to
set a sufficient bond for surety to be posted by the designated administrator.
16. Petitioner is ready, willing and able to serve as administrator.
17. The conflict between the petitioner and the father of the deceased prevents them from
serving as co-administrators and neither will consent to the appointment of the other as
administrator .
WHEREFORE the petitioner prays that a citation be awarded pursuant to 20 Pa.C.S.A..
