DAVIDSON, of Lower Allen Township, Cumber- land County, Pennsylvania, make, publish and declare this as andc for my Last Will and Testament, hereby revoking all other Wills h and Codicils heretofore made by me. FIRST: Except as specifically set forth hereinbelow, I direct that all of my personal property, of whatever nature and whatever type, be sold by a reputable auctioneer to be selected by my Executor, as hereinafter named, in consultation with my cousin, FRED D. OYLER, of 519 Bosler Drive, Carlisle, Pennsylvania. The proceeds resulting therefrom shall be and become a part of the rest, residue and remainder of my estate, to be disposed of as set forth hereinbelow. SECOND: I direct that my burial take place in the Family Plot, Lot No. 412, Big Spring Presbyterian Graveyard, Newville, Pennsylvania. Further, I direct that my Executor, as hereinafter named, provide a headstone for my grave, same to be purchased from Eby Granite Works, Newville, Pennsylvania, which headstone shall be consistent in appearance with the other head- stones in the Family Plot. THIRD: I give and bequeath to KATHERINE FUSSELL, of 698 Circle View Road, Luray, Virginia, the following specifically designated items of personal property: (A) Diamond ring consisting of six (6) diamonds which was given to me by my sister. (B) Emerald and diamond ring belonging to my mother, who gave same to my sister. (C) Oval shaped emerald earrings with three (3) diamonds each; nine (9) strand freshwater pearl necklace, fresh- ~ -1 g ". re cl water pearl drop earrings; double strand freshwater pearl necklace - all given by KATHERINE'S grandmother to my sister. FOURTH: I give and bequeath my antique pearl sunburst pin, which belonged to my mother, and matching earrings, to SUSAN SHOCKEY, of 5232 Meadowbrook Drive, Mechanicsburg, pennsylvania. SUSAN SHOCKEY is the daughter of my good friend, Betty Gayman. FIFTH: I give and bequeath my cherry and curly-maple chest of drawers with glass knobs, and my walnut side chair with an eggplant needlepoint seat, which came from the Davidson Family, to my cousin, FRED D. OYLER, provided, however, that should he predecease me, then to his son, THOMAS S. OYLER. SIXTH: I give and bequeath my six (6) coin silver teaspoons bearing the initials "L. Me. F.", which have passed successively to the youngest daughter of each generation of my family, to my namesake, JANE ELIZABETH KUHN. It is my desire that, insofar as possible, JANE ELIZABETH KUHN establish in her family the same custom of having the teaspoons descend to the youngest daughter of each generation as has existed in my family. SEVENTH: I give and bequeath the following to my good friend, ELMA T. KREPS, of 325 Wesley Drive, Apartment 3227, Mechanicsburg, Pennsylvania: Two Antique Elgin Watches; one gold chain that goes with the watches; and one gold Fleur-de-Lis Pin. EIGHTH: I give and bequeath my mahogany sewing table with glass knobs (originally owned by Rebecca Wightman, an early Carlisle public school teacher) to the CUMBERLAND COUNTY HISTOR- ICAL SOCIETY. NINTH: Should any of the individuals set forth in Clauses THIRD, FOURTH, FIFTH, SIXTH and SEVENTH predecease me, I direct that those bequests shall lapse and shall be and become a part of the rest, residue and remainder of my estate to be dis- tributed as set forth hereinbelow. 2 ~ ~ ~ ~ ~ TENTH: I devise and bequeath all the rest, residue and remainder of my estate of whatever nature and wherever situate, including any property over which I hold power of appointment and together with any insurance policies thereon, as follows: (A) Ten (10%) percent thereof to the BIG SPRING UNITED PRESBYTERIAN CHURCH of Newville, Pennsylvania, in memory of the James Talbot Dunfee Family. If, however, the BIG SPRING UNITED PRESBYTERIAN CHURCH of Newville, Pennsylvania, is not in existence at the time of my death or if said Church has merged with some other Church prior to my death, I direct that this residuary bequest shall lapse and be and become a part of the rest, residue and remainder of my estate to be distributed in the same proportion as the remaining residuary bequests as set forth herein. (B) Twenty (20%) percent thereof to the FRONT ROYAL PRESBYTERIAN CHURCH of Front Royal, Virginia, in memory of my sister, SARA DAVIDSON PLEASANTS and her husband, MARION M. PLEASANTS. (C) Twenty (20%) percent thereof to the PI BETA PHI FOUNDATION FOR ARROWMONT, of 1154 Town & Country Commons Drive, Town & Country, Missouri 63017. (D) Twenty (20%) percent thereof to the BAUGHMAN MEMORIAL UNITED METHODIST CHURCH of New Cumberland, Pennsylvania. (E) Thirty (30%) percent thereof to the CARE ASSURANCE ENDOWMENT FUND, Bethany Village, Mechanicsburg, Pennsylvania. ELEVENTH: In addition to all powers granted to them by law and by other provisions of this Will, I give the fiduciaries acting hereunder the following powers, applicable to all proper- ty, exercisable without court approval and effective until actual distribution of all property: (A) To sell at public or private sale, or to lease, for any period of time, any real or personal property and to give 3 ~ ~ ~ ~ ~ ~ ~ ~ options for sales, exchanges or leases, for such prices and upon such terms (including credit, with or without security) or conditions as are deemed proper. This includes the power to give legally sufficient instruments for transfer of the property and to receive the proceeds of any disposition of it. (E) To partition, subdivide, or improve real estate and to enter into agreements concerning the partition, subdivi- sion, improvement, zoning or management of real estate and to impose or extinguish restrictions on real estate. (e) To compromise any claim or controversy and to abandon any property which is of little or no value. (D) To invest in all forms of property, including stocks, common trust funds and mortgage investment funds, without restriction to investments authorized for Pennsylvania fiduci- aries, as are deemed proper, without regard to any principle of diversification, risk or productivity. (E) To exercise any option, right or privilege granted in insurance policies or in other investments. (F) To exercise any election or privilege given by the Federal and other tax laws, including, but not necessarily being limited to, personal income, gift and estate or inheritance tax laws. (G) To make distributions to my herein named benefici- aries in cash or in kind or partly in each. (H) To borrow money from themselves or others in order to pay debts, taxes, or estate or trust administration expenses, to protect or improve any property held under my will, and for investment purposes. (1) To select a mode of payment under any qualified retirement plan (pension plan, profit sharing plan, employee stock ownership plan, or any other type of qualified plan) to the extent the plan or the law permits them to do so, and to exercise 4 any other rights which they may have under the plan, in whatever manner they consider advisable. TWELFTH: I direct that all inheritance, estate, transfer, succession and death taxes, of any kind whatsoever, which may be payable by reason of my death, whether or not with respect to property passing under this Will, shall be paid out of the principal of my residuary estate. THIRTEENTH: All interests hereunder, whether principal or income, which are undistributed and in the possession of the fiduciaries acting hereunder, even though vested or distribut- able, shall not be subject to attachment, execution or sequestra- tion for any debt, contract, obligation or liability of any beneficiary, and furthermore, shall not be subject to pledge, assignment, conveyance or anticipation. FOURTEENTH: I nominate and appoint JAMES D. BOGAR, Executor of this, my Last Will and Testament. I direct that my Executor, shall not be required to post security or a bond for the performance of his duties in any jurisdiction.
