APPEAL OF LICENSE SUSPENSION AND REQUEST FOR HEARING
AND NOVV, this 8th day of March 2005, comes the Appellant, Patrick Thomas
Murphy, and files this Appeal of License Suspension, and in support thereof avers the
following:
1.
The Appellant is Patrick Thomas Murphy, an adult individual
currently residing at I Teaberry Drive, Carlisle, PA 17013,

On or about 23 June 2002, the Appellant was charged with an
Underage Alcohol Offense pursuant to Title 18, Pa,C,S,A Section
6308.

At the same time he was charged with a Vehicle Code Offense for
Leaving the Scene of an Accident under 75 P A Vehicle Code,
Section 3745,

Appellant entered a guilty plea verdict to the Vehicle Code offense
on July 25, 2002, and received a suspension of his driving
privilege for a period of 120 days, effective September 6, 2002,

attached hereto, made a part hereof and marked as Exhibit "A."
At the time of entry of plea to the Vehicle Code offense, the
underage drinking offense was held in abeyance pending the
Appellant's completion of alcohol classes,
On January 23, 2003, the Appellant was found guilty of the
underage drinking offense and received, inter alia, a license
suspension for a period of two (2) years, effective August 5, 2004,

In June 2004 the Appellant filed a Petition for Allowance of
Appeal Nunc Pro Tunc and asked that a Rule be Issued on the
Commonwealth to Show Cause why the Appellant should not be
permitted to file a Nunc Pro Tunc Appeal of the January 23, 2003,
conviction based upon the issues of double jeopardy and joinder.
The commonwealth did not respond to the Rule; therefore, the
Appellant filed a notice of summary appeal nunc pro tunc on July
21,2004.
A de novo hearing on the summary appeal nunc pro tunc was
originally scheduled for September 2004, but was continued until
October 12th 2004, at which time, after testimony, the Court denied
the Appellant's summary appeal.
On November 23, 2004, the Appellant was sentenced to 90 days
probation and to pay costs,

Notwithstanding the nunc pro tunc appeal, at all times leading up
to the summary appeal and at all times after August 5, 2004, the
Appellant has recognized and has been serving his license
suspension for the guilty verdict of January 23, 2003,
Subsequent to the recent denial of his appeal, on February 9, 2005,
the Appellant received notification from the Pennsylvania
Department of Transportation that his license would be suspended
for a period of two years for the June 23, 2002 violation, effective
August 5, 2006, Please see a copy of the correspondence from the
Department of Transportation, which is attached hereto, made a
part hereof and marked as Exhibit "B".
PennDOT has erroneously suspended Appellant's license two (2)
times based upon the same conviction, that being the June 23,
2003, violation of Title 18, Section 6308, for Underage Drinking,
The most recent notice of suspension for such offense begins to
run at the end of Appellant's previous suspension for the same
offense,
PennDOT has erred and needs to correct such error so that
Appellant's driving record reflects that his suspensions for the June
23,2003 offense ends on August 5, 2006.

WHEREFORE, Appellant respectfully requests this Honorable Court
grant his Appeal of License Suspension and Order that PennDOT amend the
Appellant's driving record so that he will not face a double suspension for the
same offense,
