AND NOW, TO WIT, this 1st day of ~, 2005, comes the above captioned
Plaintiff, Charles L. Stump, by and through his attorney, Blakey, Yost, Bupp & Rausch, LLP, and
files the within Complaint to which the following is a statement:
I. Plaintiff, Charles L. Stump, is an adult individual residing at 61 Range End Road,
Dillsburg, P A 17019,
2. Defendant, Martin Gerry Kime, is an adult individual residing a 2400 Deerview
Drive, Mechanicsburg, PA 17055.
3. On October 29,2004, Plaintiff was driving his 1987 Yamaha V' go motorcycle, in
Upper Allen Township in Cumberland County, Pennsylvania. See Police Repo attached as Exhibit
"A" and incorporated herewith,
4, On October 29, 2004, Defendant was driving his 2000 Dodge C ravan and pulled
out in front of Plaint iff, causing Plaintiff to lock his brakes and lay his motorcy Ie down on its side,
causing damage to the motorcycle making it unsafe to drive. See Exhibit "A",
5. Plaintiff incurred a towing charge of$100.00 and storage charg s of$300,OO for his
motorcycle, See Hess Garage, Inc, receipt attached as Exhibit "B" and incorpor ted herewith.
6, Plaintiff delivered his motorcycle to Camp Hill Yamaha for an estimate to repair the
damages; a verbal estimate of $3,200.00 was given to Plaintiff.
7. Defendant's insurance company, State Farm Insurance, totaled e motorcycle and
took it to a salvage yard, and only offered $1,600.00 to Plaintiff for the value 0 his motorcycle.
8, Plaintiff still owed $2,184.22 on his motorcycle as ofNovembe 29,2004. Plaintiff's
Statement is attached as Exhibit "e" and incorporated herewith,
9. Plaintiff's motorcycle jacket and chaps valued at $135.00 total ere damaged during
the accident. See Receipt #60478 I dated September 2, 2004 attached as Exhibi "D" and
incorporated herewith,
10. Plaintiff paid $15,00 for an accident report, See Receipt #162 d ted January 10,
2005 attached as Exhibit "E" and incorporated herewith,
II. Plaintiff has sustained loss of use of his motorcycle from the da ofthe accident
through the date of the filing of this Complaint, for a total of 157 days. The val e of the loss of use
is $15.00 per day for a total value of $2,355.00,
COUNT I - NEGLIGENCE
12. Paragraphs I through II are incorporated by reference as if set rth in full.
13. At all times relevant hereto, Plaintiff was obeying all traffic law and was lawfully
driving his motorcycle upon the public highway.
14. The Defendant owed a duty of care to Plaintiff in that he was re uired to operate his
vehicle in a safe manner without harm to Plaintiff.
15. Defendant breached his duty because he pulled his vehicle out in front of Plaintiff
causing Plaintiff to sustain damage to his motorcycle.
16. The direct and proximate result of Defendant's breach of duty t Plaintiff caused
Plaintiff to sustain $5,089,22 in damages.
WHEREFORE, Plaintiff, Charles L. Stump, respectfully requests this onorable Court to
enter judgment in his favor and against the Defendant in the amount of$5,089. 2, plus court costs
associated with this action, statutory interest and any relief this Court deems ju and proper.
COUNT II - TRESPASS TO CHATTEL
17. Paragraphs 1 through 16 are incorporated by reference as if set rth in full.
18. Defendant's aforementioned improper and negligent actions co stitutes a trespass to
Plaintiff's chattel, namely his 1987 Yamaha motorcycle.
19. The direct and proximate result of Defendant's trespass to Plain iffs chattel has
caused Plaintiff to incur damages of$5,089,22.
WHEREFORE, Plaintiff, Charles L. Stump, respectfully requests this onorable Court to
enter judgment in his favor and against the Defendant in the amount of$5,089, 2, plus court costs
associated with this action, statutory interest and any relief this Court deems ju and proper,

On 10-29-2004 at approximately 0650 hours Unit #2 operator was traveling S lh on S Market
51. It was before dawn, the weather \'1as clear and the roads were dry. Unit #2 perato r stated
he was tra'leling 40 mph when Unit #1 pulled out in front of him from a s,ide st €let causing him
to lock his brakes and lay his molorcyde down on its side. Unit #1 operator st ted that he did
not see the motorcycle and procee-ded through the stop sign at Round Ridge d thinking it wa s
clear. The two vehicles did not make physical contact but Unit #2 did recei'le am age making it
~ unsafe to drive. Uni t #2 was towed by Hess Garage

4. It is admitted that Defendant was driving a 2000 Dodge Caravan on October 29,
2004. The remaining allegations of this paragraph are denied in accordance with Pennsylvania
