PETITION FOR RULE FOR JUDICIAL SALE
The Cumberland County Tax Claim Bureau, by its attorney, Keith 0. Brenneman,
Cumberland County Assistant Solicitor, files this Petition for Rule for Judicial Sale, as
follows:
Your Petitioner is the County of Cumberland through its Tax Claim
Bureau, a Bureau created by the Real Estate Tax Sale Law. 72 P.S.
§5860.101, et seq.
2. Pursuant to 72 P.S. §5860.610, your Petitioner respectfully represents
as follows:
a. Tax claim upon which the property was exposed for sale: 2011 and
2012 Cumberland County, Library and Hampden Township real
estate taxes. Total amount of taxes, including penalty, interest, and
cost as of date of tax sale: $209.58.
b. Neither the owner, his, her, their, or its heirs, successors, assigns, or
legal representatives, or any lien creditor, or his, her, their or its
heirs, successors or legal representatives, or any other person
interested, has caused discharge of tax claim or removal from tax
sale.
c. The property was exposed to public sale pursuant to 72 P.S.
§5860.601 on: September 19, 2013.
d. Before exposing the property to public sale the Bureau fixed
the upset sale price, pursuant to 27 P.S. §5860.605, which upset
price was $214.12.

e. Your Petitioner, the Bureau, was unable to obtain a bid at the public
sale sufficient to pay the said upset price.
3. Attached hereto, marked Exhibit "A," and incorporated herein by
reference as if fully set forth herein, is a vehicle record abstract from
the Pennsylvania Department of Transportation, Bureau of Motor
Vehicles, referencing the mobile home by V.I.N. number 10575819
and owner as Sithone Sibounheuang. The tax parcel number of the
property as recorded in the assessment office is 10 -22- 0523 -024
TR08391 and owner as Sithone Sibounheuang as indicated on the tax
property record card hereto attached as Exhibit "B ". The property is
situated in the Township of Hampden, Cumberland County
Pennsylvania, and is known as 27 Kingsbury.
4. The names and addresses of known parties holding tax and municipal
claims, liens, mortgages, ground rents, charges and estates against
the property are as follows:
a. Cumberland County Tax Claim Bureau

Delinquent taxes as of February 1, 2014: $229.35
(Includes 2011, 2012 and 2013 county /municipal real estate
taxes). Said amounts will continue to accrue interest and costs. All
delinquent claims must be satisfied to stay Judicial sale.

Subject property is situate on rented lot no. 27 in Kingsbury MHC.
4. The last known address of the owner of the property as set forth in the
assessment records of Cumberland County is: Sithone Sibounheuang,
5169 East Trindle Road, Lot 27, Mechanicsburg PA 17050. Certified and
regular mail correspondence sent to said address was returned to the
Bureau as unclaimed and moved left no forwarding. In its efforts to obtain
a viable address, the Bureau has discovered that the Respondent is
deceased. Relatives of the deceased were found to be Khanh
Sibounheuang and Boutsy B. Sibounheuang at 339 S. Ridge Rd., Lot 3,
York Springs, PA 17372 -8722. In light of the foregoing, your Petitioner
requests that the Court's Rule to Show Cause be served upon Khanh
Sibounheuang and Boutsy B. Sibounheuang at their last known address
and heirs of Sithone Sibounheuang by publication of the advertisement
hereto attached as Exhibit "C" once in the Cumberland Law Journal, and
once in the Patriot News at least fifteen days prior to the rule returnable
date, pursuant to PA R.C.P 430.

WHEREFORE, Your Petitioner prays your Honorable Court to grant a rule upon
all interested parties, including those listed at paragraphs four and five of the within.
Petition, to show cause why a decree should not be made that the property be sold,
freed and cleared of tax and municipal claims, liens, mortgages, charges and estates,
except separately taxed ground rents, pursuant to Section 612 of the Real Estate Tax
Sale Law. 72 P.S. §5860.612(a).

MOTION TO RESCHEDULE RULE RETURABLE DATE
ON JUDICIAL SALE
Cumberland County Tax Claim Bureau, by its attorney, Keith 0. Brenneman, Esquire,
Cumberland County Assistant Solicitor, files this Motion and in support thereof states the
following:
1. On or about March 7, 2014 Petitioner Cumberland County Tax Claim Bureau filed a
Petition For Rule For Judicial Sale requesting this Court to grant a Rule on all interested parties
to show cause why a decree should not be made that the property subject to the Petition should
not be sold at a judicial sale.
2. This Court issued a Rule to Show Cause on March 7, 2014 with a Rule returnable
March 26, 2014.
3. Petitioner neglected to advise the Court that due to various service requirements
applicable to the Rule to be issued by the Court with respect to a judicial sale of property, that a
Rule returnable date should be scheduled at least sixty days in the future.
4. Petitioner requests the Court to establish a date for the Rule returnable at least sixty
days after the filing of this Motion.
5. This matter has been assigned to the Honorable Thomas A. Placey who issued the
Rule to Show Cause dated March 7, 2014.
WHEREFORE, Cumberland County Tax Claim Bureau requests this Court to reissue a
Rule to Show Cause with respect to the proposed judicial sale of the subject property containing
a Rule returnable date at least sixty days after the date of the filing of this Motion.

MOTION TO RESCHEDULE RULE RETURNABLE
ON REQUEST FOR JUDICIAL SALE
The Cumberland County Tax Claim Bureau, by its attorney, Keith O. Brenneman,
Cumberland County Assistant Solicitor, submits this Motion and in support thereof, states the
following:
1. Cumberland County Tax Claim Bureau on March 4, 2014 filed 19 separate Petitions
requesting this Court to issue a Rule to Show Cause why certain properties that were not sold at
tax upset sales held on September 19, 2013 should not be sold at judicial sale.
2. As a result of the filing of the Petitions filed March 4, 2014 this Court issued Rules to
Show Cause at the request of counsel for the Cumberland County Tax Claim Bureau,
establishing Rules returnable in each of the Petitions filed for May 16, 2014 at 9:00 o'clock A.M.
in Courtroom No. 6 of the Cumberland County Courthouse.
3. With respect to the matter docketed to No. 2014-1259, the Cumberland County Tax
Claim Bureau was able to obtain proper service on all property owners, tax collectors and known
parties having claims, liens, mortgages and other charges against the property subject to this
matter with the exception of the owners of the manufactured home community property where
the manufactured home subject to the real estate tax liens giving rise the efforts to sell the same
is located.
4. The Cumberland County Tax Claim Bureau is unable, after reasonable diligence, to
locate and personally serve the owners of the of the manufactured home community property
where the subject manufactured home is located, having only a post office box address to which
personal service cannot properly be made.
5. For the reason noted in Paragraph 4, above, the Cumberland County Tax Claim
Bureau is unable to obtain proper service on owners Russell C. and Janet D. Goodling of the
Rule issued by the Court in this matter.
6. All other persons and parties having an interest in the property identified by Tax
Parcel No. 10-22-0523-024 TR08391 have been properly served with notice of the Rule
returnable date and the Petition in this matter.
7. Cumberland County Tax Claim Bureau is requesting this Court to reschedule the Rule
returnable date on the Petition For Rule For Judicial Sale with respect to the property identified
by Tax Parcel No. 10-22-0523-024 TR08391.
8. This matter has been assigned to the Honorable Thomas A. Placey who issued the
Rule to Show Cause dated March 18, 2014.

WHEREFORE, the Cumberland County Tax Claim Bureau requests this Court to re -issue
a Rule to Show Cause for a date returnable July 11, 2014 at 9:00 o'clock a.m., which is the date
and time established by the Court to hear similar cases continued by motion of the Cumberland
County Tax Claim Bureau, so that service can be made upon Russell C. and Janet D. Goodling
by publication once in both the Cumberland Law Journal and The Patriot -News at least 15 days
prior to the Rule returnable date, and that those persons and parties already served with notice of
the Rule returnable date of May 16, 2014 be provided with notice of the rescheduled Rule
returnable by regular first class mail, postage prepaid.
