WHEREAS, Beracah Builders, LLP, entered into a contract with Kristen Kost and
David Kost, Borrowers, to provide the materials and labor necessary for construction on
a home at 6370 Peregrine Way, Hampden Township, Cumberland County,
Pennsylvania, more particularly bounded, limited and described in Exhibit "A", attached
hereto and made a part hereof.
NOW, THEREFORE, it is hereby stipulated and agreed by and between the
said parties as part of the said contract and for the consideration therein set forth that
neither the undersigned contractor, and sub-contractor or material man; nor any other
person furnishing labor or materials to the said contractor under said contract shall file
a lien, commonly called a mechanics lien, for work done or materials furnished to the
said building or any part thereof.
This stipulation is made and intended to be filled with the Prothonotary of
Cumberland County, Pennsylvania, within ten (10) days after date, in accordance with
the requirements of the Act of Assembly of Pennsylvania in such case provided.

ALL THAT CERTAIN tract of parcel of land known as Lot/Unit 4 - Hawks Landing, as
shown on a plan prepared by NAV Tech, Inc. titled "Preliminary/Final Subdivision and
Land Development Plan for Hawks Landing" as recorded in Cumberland County
Recorder of Deeds Office Plan Book 93, Page 107F, situated in Hampden Township,
Cumberland County, Pennsylvania is bounded and further described as follows, to wit:
BEGINNING at a point on the North line of Peregrine Way, a 50 foot wide street, said
point being the common front lot comer with Lot 5, thence along the following courses
and distances: a curve to the left having a radius of 225.00 feet and length of 85.00
feet, a chord bearing of North 44 degrees, 17 minutes, 05 seconds West, and a chord
length of 84,50 feet; North 33 degrees, 33 minutes, 53 seconds East (158.32 feet);
South 20 degrees, 36 minutes, 46 seconds East (160.73 feet) along lands of N/F
William and Iris Rouse; South 62 degrees, 29 minutes, 25 seconds West (103.41 feet)
along the common line with Lot 5, to a point being the point of BEGINNING.
