PETITION TO UNILATERALLY ENGAGE REALTOR
AND NOW comes Petitioner, Douglas Clouser, as co-personal
representative of the above Estate, by and through his Counsel, Michael O.
Palermo, Jr. and files the following Petition:
1. Your Petitioner is Douglas Clouser as co-personal representative of
the Estate of David H. Clouser.
2. Respondent is Debra Houseman, additional co-personal
representative and sister of Petitioner.
3. Petitioner and Respondent serve as co-representatives pursuant to
the Last Will and Testament of the deceased, their biological father.
4. The vast majority of estate assets have been sold at auction and
the residence at 1204 Mitchell Drive, Mechanicsburg, Pennsylvania has been
rehabilitated to the point where it is appropriate to list the same for sale.
5. Petitioner has engaged and signed a sales agreement with Lee Smith
of Coldwell Banker - Homestead Group to list and sell the estate property.
6. After contacting counsel for Co-Administrator Houseman, Attorney
Mark Thomas, the undersigned was informed that she could not be located to
obtain her consent/signature to the listing agreement.
7. Attorney R. Mark Thomas was contacted regarding the relief sought
herein and as he cannot obtain a response from his client, he cannot consent
to this instant Petition, however Attorney Thomas will not be opposing this
Petition.
8. The Honorable M.L. Ebert, Jr. has entered all the previous Court
Orders in the above captioned matter.
WHEREFORE, your Petitioner respectfully requests that this
Honorable Court permit Douglas Clouser, Co-Administrator of the above
estate to unilaterally sign a binding sales/listing agreement on behalf of
the Estate of David H. Clouser and thus engage Lee Smith of Coldwell
Banker - Homestead Group in regards to the listing of the Estate
Property located at1204 Mitchell Drive, Mechanicsburg, Pennsylvania.
