Tax Parcel ID: 01 -21- 0273 -134 Municipality: Camp Hill Borough PETITION FOR APPEAL OF BEVERLY PARK TRUST FROM ASSESSMENT APPEAL DECISION OF CUMBERLAND COUNTY BOARD OF ASSESSMENT APPEALS Petitioner /Taxpayer, Beverly Park Trust, a Pennsylvania trust, owner of the above - referenced residential property, by and through its attorneys, James A. Diamond, Esquire and the law firm of Eckert Seamans Cherin & Mellott, LLC, avers as follows: 1. This appeal is taken pursuant to the Act of July 9, 1976, P.L. 586, as amended 42 Pa. C.S.A. § 5571(b), and the Consolidated County Assessment Law, as amended 53 Pa. C.S.A. § 8854, et seq. 2. Appellant is Beverly Park Trust, a Pennsylvania trust, with a mailing address of P.O. Box 1064, Mechanicsburg, PA 17055 -1064. 4103 .?'5 AL09 {L0548144.1} C) l 3. Appellee is the Cumberland County Board of Assessment Appeals (the "Board "), a Board of Assessment Appeals within the meaning of 53 Pa. C.S.A. § 8802. 4. Appellant is the owner of the residential property located at 96 Westerly Road, Camp Hill Borough, PA, identified as tax parcel 01 -21- 0273 -134 (the "Property "), having acquired ownership of the Property on July 12, 2013 as the result of an arms- length open market transaction. after the Property was listed on the Central Penn Multi -List. 5. Appellant purchased the subject Property on July 12, 2013 for a total purchase price of $119,009. 6. The Board's assessment of the Property is $175,300. 7. The Cumberland County established predetermined ratio is 100% of the 2010 base year assessment. 8. The Cumberland County Common Level Ratio as determined by the State Tax Equalization Board, for the tax year involved is 103.1 % ( "CLR "). 9. At a February 20, 2014 hearing before the Board, Appellant presented evidence that the market value of the Property was $119,009. 10. The market value of the Property as of the date that appeal was filed with the Board was $119,009. 11. By a Board of Assessment Appeals Decision Notice mailed February 21, 2014, the Board issued a determination revising and changing the old assessment of $183,900 to the revised assessment of $175,300, a copy of which is attached hereto and marked as "Exhibit A." 12. Based upon the CLR of 103.1 % and the Board's old assessment of $183,900, the assessment's implied market value of the Property was approximately $189,600.90; the revised assessment of $175,300 reflects an implied market value of approximately $180,734.30. fL0548144.1) 2 13. The Board's revised assessment of the Property does not accurately reflect its present fair market value. 14. Appellant obtained an appraisal report on the Property which further supports that the revised Property assessment is substantially higher than the present fair market value. 15. The Board's revised assessed value of the Property is arbitrary, unreasonable, erroneous, and contrary to law, because: (a) The revised assessment drastically overstates the value of the Property and does not reflect the present fair market value; (b) The revised assessment is substantially higher than assessments of comparable properties in the taxing district; (c) The impact of the revised assessment bears unequally on Appellant when compared to assessments of properties of the same class; (d) The revised assessment violates the Uniformity Clause of the Pennsylvania Constitution for reasons which include, but are not limited to, its employment of an outdated assessment causing non - uniform assessment in Cumberland County; (e) The revised assessment violates the Equal Protection Clause of the United States Constitution; and (f) The revised assessment is unjust and inequitable. { L0548144.1 } 3 WHEREFORE, Appellant respectfully requests that this Honorable Court vacate the decision of the Cumberland County Board of Assessment Appeals and enter an Order re- assessing the Property at a value reflecting its fair market value of $119,009, together with such other and further relief as the Court shall deem appropriate.
