No. COMPLAINT Plaintiff, Erie Insurance Company, as Subrogee of /to its insured, Pippa S. Calland (hereafter "Subrogor "), hereby files this Complaint against Defendant, Jennifer Collins and, in support hereof, avers as follows: The Parties 1. Plaintiff, Erie Insurance Company, is an insurance business corporation with offices at 100 Erie Insurance Place, Erie, Pennsylvania 16530. 2. Subrogor is an adult citizen of Pennsylvania and resides in Cumberland County, Pennylvania. 3. Defendant, Jennifer Collins, is, upon information and belief, an adult citizen of Pennsylvania residing at the above stated address. Jurisdiction and Venue 4. The Court has original jurisdiction over the subject matter of this action by virtue of 42 Pa. C.S. § 931. 5. The amount in controversy in this action is less than $50,000.00, exclusive of interest and costs. 6. The events from which this action arises occurred in Cumberland County, Pennsylvania. Factual Background 7. On or about August 16, 2010, Plaintiff and Defendant entered into a Lease Agreement (the "Agreement ") whereby Defendant agreed to lease certain premises located at 511 West Main Street, Mechanicsburg, PA 17055 (the "Premises ") according to the terms set forth in the Agreement. 8. A true and correct copy of the Agreement is attached hereto and marked as Exhibit A 9. Pursuant to the terms of the Agreement, Defendant is responsible for "...all damage to the leased premises ... caused by tenant, Tenant's family or guests." See Exhibit A . 10. During the course of Defendant's tenancy, Defendant caused extensive property damage to the Premises in the sum of $7,107.85. 11. A true and correct copy of the damage estimates and bills are attached hereto and marked as Exhibit B . 12. On the date of entering into the Agreement, and at all times relevant to this action, Subrogor held a property insurance policy underwritten by Plaintiff (the "Policy "), pursuant to which Policy the claims that are the subject of this action have been assigned by Subrogor to Plaintiff. 13. Plaintiff paid Subrogor the sum of $7,107.85 under the Policy for the extensive property damage caused to the Premises by Defendant during the course of her occupancy of the Premises. COUNT ONE — BREACH OF CONTRACT 14. All preceding paragraphs of this Complaint are incorporated herein as though fully set forth at length. 15. Pursuant to the terms of the Agreement, Defendant is responsible for "...all damage to the leased premises ... caused by tenant, Tenant's family or guests." See Exhibit A . 16. During the course of Defendant's occupancy of the Premises, Defendant caused extensive property damage in the sum of $7,107.85. See Exhibit B . 17. Plaintiff paid to Subrogor the sum of $7,107.85 under the Policy for the property damage caused to the Premises by Defendant during the course of her occupancy of the Premises. 18. According to the terms of the Agreement, and as the assignee of Subrogor's right of recovery, Defendant owes to Plaintiff the sum of $7,107.85 for damages caused to the Premises. 19. Notwithstanding demand, Defendant has refused and continues to refuse to make payment as required under the terms of the Agreement. WHEREFORE, Plaintiff demands judgment against Defendant in the sum of $7,107.85, together with any and all applicable interest, costs of suit, collection costs, inclusive of, without limitation, reasonable attorneys' fees, and all such other and further relief as the Court deems just and equitable. COUNT TWO — NEGLIGENCE 20. All preceding paragraphs of this Complaint are incorporated herein as though fully set.forth at length. 21. At all relevant times, Defendant had a duty to act with reasonable caution, diligence and care so as not to cause unnecessary property damage/harm to the Premises during the course of her occupancy of the Premises. 22. Defendant breached that duty by causing and /or otherwise allowing extensive property damage to occur in and to the Premises in the sum of $7,107.00. 23. Defendant is liable to Subrogor for all of the property damage that Subrogor suffered as a result of Defendant's negligence and /or recklessness during the course of Defendant's occupancy of the Premises. 24. Plaintiff paid Subrogor the sum of $7,107.85 under the Policy for the extensive property damage caused to the Premises by Defendant during the course of her occupancy of the Premises. 25.. As assignee of Subrogors' right of recovery, Plaintiff is entitled to recover from Defendant the sum of $7,107.85, together with all other amounts which may be authorized by contract and/or law without limitation. WHEREFORE, Plaintiff demands judgment against Defendant in the sum of $7,107.85, together with any and all applicable interest, costs of suit, collection costs, inclusive of, without limitation, reasonable attorneys' fees, exemplary and/or punitive damages in an amount to be determined and all such other and further relief as the Court deems just and equitable. THIS RESIDENTIAL LEASE CONTAINS WAIVERS OF YOUR RIGHTS AS A TENANT. EACH TENANT SHOULD NOT SIGN THIS LEASE UNTIL EACH TENANT UNDERSTANDS ALL OF THE AGREEMENTS IN THIS LEASE. I. Calland M.D. Name(s) of the Tenant(s): Jennifer Collins 2. LEASED PREMISES The leased premises is the place that the Landlord agrees to lease to Tenant. The leased premises is: 511 West Main Street, Mechanicsburg Pennsylvania 17055 3. STARTING AND ENDING DATES OF LEASE AGREEMENT This lease starts Au usg t 15, 2010 This lease will terminate upon the end of a ten (10) month period (ending June 15, 2011) OR upon the sale of the premises, WHICHEVER OCCURS FIRST After June 15, 2011, this lease may be renewed thereafter by mutual, written agreement between the . Landlord and Tenant. 4. RENT The amount of rent is $700.00 each month and is payable to Pippa Calland. Tenant agrees to pay the monthly rent in advance on or before the fifteenth (15 day of each month. Landlord does not have to ask (make demand upon) tenant to pay the rent. Tenant agrees to pay rent by depositing it into Pippa Calland's Members First Bank checking account. Tenant agrees to pay a late charge of $5.00 per day if Tenant does not pay the rent on time. 5. SECURITY DEPOSIT Tenant agrees to pay a security deposit of $700.00. Tenant agrees to pay the security deposit to Pippa Calland before the lease starts and before Landlord gives possession of the leased premises to Tenant. Landlord can take money from the security deposit to pay for any damages caused by Tenant, Tenant's family and Tenant's guests. Landlord may take the security deposit to pay for any unpaid rent. After taking out for damages and unpaid rent, Landlord agrees to send to Tenant any security deposit money left over. Landlord will send the remaining security deposit money to Tenant no later than thirty (30) days after the lease ends and Tenant leaves. Landlord also agrees to send to Tenan t a written list of damages and amounts of money taken from the security deposit. Tenant agrees to give Landlord a written forwarding address when Tenant leaves and the lease ends. Tenant may not use the security deposit as payment of the last month's rent. 6. LANDLORD'S DUTY AT THE START OF THE LEASE Landlord agrees, to give Tenant possession of the leased premises on the starting date of the lease. The lease will start even if Landlord cannot give Tenant possession, of the leased premises because the Landlord is , s till in the leased premises or the leased premises are damaged. IF LANDLORD CANNOT GIVE TENANT POSSESSION, TENANT DOES NOT HAVE TO PAY RENT UNTIL THE DAY LANDLORD GIVES POSSESSION OF THE LEASED PREMISES TO TENANT. 7. DAMAGE TO LEASED PREMISES Tenant agrees to notify Landlord immediately if the leased premises are damaged by fire or any other cause. Tenant agrees to notify Landlord if there is any condition in the leased premises that could damage the leased premises or harm Tenant or others. If Tenant cannot live in the whole leased premises, because it is damaged or destroyed, Tenant may: 1) - live in the undamaged part of the leased premises and pay less rent until the leased premises is repaired; or 2) end the lease and leave the leased premises. Tenant agrees that if the leased premises is damaged or destroyed and Tenant ends the lease, Landlord has no further responsibility to Tenant. 2 S. INSURANCE Tenant's own property is NOT insured by Landlord's insurance. Tenant is responsible for any damage to or loss of Tenant's own property that is located in the leased premises. Accordingly, by the signing date of this lease agreement, Tenant is required to obtain personal property/renter's insurance and maintain such coverage for the duration of this lease. Landlord agrees to maintain Homeowner's insurance coverage. 9. ASSIGNMENTS OR SUBLEASES BY TENANT ASSIGNMENT (OR ASSIGN) is the legal term for a transfer of the lease from the Tenant to another person. This other person then becomes the Landlord's new Tenant and takes over the lease. Tenant agrees NOT to transfer (assign) this lease to anyone else without the written permission of Landlord. A sublease is a separate lease between the Tenant and another person who leases all or part of the leased premises from the Tenant. Tenant agrees NOT to lease (sublease) all or any part of the lease premises to anyone else without the written consent of Landlord. Tenant agrees that if Tenant transfers this lease (assigns) or leases all or a part of the leased premises to another (sublease), Tenant has violated this lease. 10. RESPONSIBILITY FOR DAMAGE TO PROPERTY OR INJURY TO Landlord is responsible for all damage to property or injury to people caused by Landlord (or Landlord's representatives) intentional or negligent acts at the leased premises. Tenant is responsible for all damage to the leased premises and injury to people caused by Tenant, Tenant's family or guests. Tenant agrees that Landlord is NOT responsible to Tenant, Tenant's family, or guests for damage or injury caused by water, snow, or ice that comes on the leased premises unless Landlord was negligent. 11. USE OF LEASED PREMISES Tenant agrees to use the leased premises only as a residence. Tenant agrees to obey all federal, state and local laws and regulations when using the leased premises. Tenant agrees NOT to store ANY flammable, hazardous, or toxic chemicals or substances in or around the leased premises. Tenant agrees NOT to do any activities in or around the leased premises which could harm anyone or damage any property. 3 . ' r Tenant agrees that tenant WILL NOT allow more than 2 people to occupy the leased premises without the written permission of Landlord. 12. RULES AND REGULATIONS Tenant agrees to obey all rules and regulations for the leased premises. If Tenant violates ANY rules or regulations for the leased premises, Tenant violates this lease. 13. LANDLORD'S RIGHT TO MORTGAGE THE LEASED PREMISES (SUBORDINATION) Subordinate and subordination are legal terms that mean that this lease does not have any effect upon the rights of the Landlord's mortgage company. In other words, Tenant's rights under this lease are subordinate to the Landlord's mortgagee company. If Landlord does not make the mortgage payments, the mortgage company may have the right to end the Landlord's ownership of the leased premises. If the mortgage company sells the leased premises at a mortgage foreclosure sale, the lease may end. Tenant agrees that Landlord has the right to mortgage the leased premises. If Landlord has a mortgage on the leased premises now, or if Landlord gets a mortgage in the future, Tenant agrees that this lease is subordinate to the Landlord's mortgage. 14. CARE OF LEASED PREMISES The leased premises are being provided fully furnished. Tenant agrees to pay for any damage caused by Tenant, Tenant's family and Tenant's guests. 15. LANDLORD'S RIGHT TO ENTER LEASED PREMISES Tenant agrees that Landlord and Landlord's representatives have the right to enter the leased premises at REASONABLE times. Landlord and Landlord's representatives have the right to inspect, to make repairs, to do maintenance, and to show the leased premises to others. 16. UTILITY SERVICES Landlord and Tenant agree to pay for the charges for utilities and services supplied to the leased premises as follows: 4 Charge or Service Paid by Television Satellite or Cable TENANT Telephone Service TENANT Internet Service TENANT Electric to Premises TENANT Water Service TENANT Natural Gas TENANT Refuse Collection TENANT Lawn/grounds Maintenance TENANT Snow and leaf removal TENANT Water softener charges TENANT Sewer charges TENANT Condominium fee N/A Homeowner's Assoc. fee N/A Parking fee N/A Other: Landlord has the right to turn off temporarily any utility or other service to the leased premises in order to make repairs or do maintenance. 17. MAINTENANCE AND REPAIRS Landlord shall be responsible for repairs in or about the leased premises unless ran by th�n�gUgence of the Tenant. Tenant will be esj)ansib1e for any senaire by her negligence. A. It is the responsibility of the Tenant to promptly notify the Landlord of the need for any such repair of which the Tenant becomes aware. B. If any required repair is caused by the negligence of the Tenant and/or Tenant's guests, the Tenant will be fully responsible for the cost of the repair and/or replacement that may be needed. C. The Tenant must keep the leased premises clean and sanitary at all times and remove all rubbish, garbage, and other waste, in a clean, tidy and sanitary manner. D. Tenant is responsible for maintaining the lawn/grounds of the leased premises and for clearing leaves, snow and ice from the leased premises. E. Tenant must abide by all local recycling regulations. F. The Tenant shall properly use and operate all electrical, cooking and plumbing fixtures and keep them clean and sanitary. G. The Tenant is not permitted to paint, make any alterations, improvements or additions to the premises without first obtaining the written permission of the Landlord. The Landlord's permission to a particular painting, alteration, improvement, or addition shall not be deemed as consent to future painting, alterations, improvements, or additions. 5 H. GOVERNMENTAL POWER OF EMINENT DOMAIN Eminent domain is the legal name for the right of a government such as the state or county or city to take private property for public use. The government must pay fair compensation to anyone who has any right in the property that is taken by the government. If all or any part of the leased premises (or the building within which the leased premises is located) is taken by eminent domain, this lease will end automatically. Landlord and Tenant agree to release each other from any responsibility because leased premises is taken by eminent domain and the lease has ended. 19. VIOLATIONS OF THIS LEASE WHEN EITHER LANDLORD OR TENANT DOES NOT DO SOMETHING THAT THEY HAVE AGREED TO DO, IT IS A VIOLATION OF THIS LEASE. IF TENANT VIOLATES THIS LEASE, TENANT MAY LOSE TENANT'S SECURITY DEPOSIT. IF TENANT VIOLATES THIS LEASE, LANDLORD ALSO CAN SUE TENANT FOR OTHER EXPENSES AND MAY SUE TO EVICT TENANT. TENANT VIOLATES THIS LEASE IF TENANT: I) FAILS TO PAY RENT OR OTHER CHARGES TO LANDLORD ON TIME, OR 2) LEAVES (ABANDONS) THE LEASED PREMISES WITHOUT THE LANDLORD'S PERMISSION BEFORE THE END OF THE LEASE, OR 3) DOES NOT DO ALL THE THINGS THAT TENANT AGREED TO DO ON THE LEASE. IF TENANT VIOLATES THIS LEASE, TENANT AGREES TO WAIVE NOTICE TO QUIT. THIS MEANS THAT THE LANDLORD MAY FILE A COMPLAINT IN COURT ASKING FOR AN ORDER EVICTING TENANT FROM THE LEASED PREMISES WITHOUT GIVING TENANT NOTICE TO QUIT FIRST.
