Shook, Esquire, who petitions this Honorable Court, pursuant to 42 Pa. C.S. § 7531, et seq. for a Declaration of Ownership of a 2002 Chevrolet Corvette automobile (Vehicle Identification Number: 1G1YY22G525131814) sufficient to permit the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles to issue a Certificate of Title to the aforementioned motor vehicle in the name of Trayer Rende and in support thereof respectfully avers: 1. Your Petitioner is Trayer Rende, an adult individual currently residing at 531 16th Street, New Cumberland, Cumberland County, Pennsylvania 17070. 2. Your respondents are the heirs of Thomas B. Stolp, deceased, the last registered owner of the subject vehicle. 3. Upon information and believe, Thomas B. Stolp passed away March 17, 2010. 4. There has been no estate raised for Mr. Stolp. 5. Capital One Auto Finance is named as a party hereto because pursuant to the Records of the Commonwealth of Pennsylvania they previously held a lien against the subject vehicle. 6. The lien of Capital One Auto Finance has expired pursuant to 75 Pa. C.S. § 1138. 7. Trayer Rende is requesting a Declaration of Ownership relative to a certain 2002 Chevrolet Corvette automobile (Vehicle Identification Number: 1 G 1 YY22G525131814)) (hereinafter sometimes referred to simply as the "automobile ") which he purchased from Donald M. Wood a /k/a Don Wood, Sr. on January 18, 2014. (A true and correct copy of the bill of sale from Donald M. Wood a /k /a Don Wood, Sr. to Trayer Rende is attached hereto, made part hereof and marked as Exhibit "A "). 8. Upon information and belief, although the vehicle was titled to Thomas B. Stolp, the vehicle was operated by and used regularly by Brittany L. Gordy. 9. Donald M. Wood a /k /a Don Wood, Sr., came into possession of the subject vehicle after he was called to tow the vehicle, which was abandoned in a flood zone near the Harrisburg Area Community College (HACC) in approximately 2010. (An Affidavit of Donald M. Wood a /k/a Don Wood, Sr. is attached hereto, made part hereof and marked as Exhibit "B "). 10.According to the Affidavit of Donald M. Wood a /k/a Don Wood, Sr., Brittany L. Gordy came to came the vehicle shortly after it was towed however she refused to pay the towing and storage fees and abandoned the vehicle on Mr. Wood's lot. 11. Mr. Wood sold the vehicle to Mr. Rende in 2014 for the unpaid storage fees and towing bill of $4,500.00. 12. Your Petitioner is a good faith purchaser. 13. Respondent abandoned the vehicle. 14. Trayer Rende, is unable to obtain a title to the subject vehicle because he does not possess sufficient documentation so as to permit Penndot to issue a Certificate of Title in his name. 15. Because of the unique circumstances of this matter, Trayer Rende is without alternative but to petition this Honorable Court for a declaration of ownership relative to the subject 2002 Chevrolet Corvette sufficient to permit Penndot to issue a certificate of title to the 2002 Chevrolet Corvette in his name. 16. With respect to these types of actions, the undersigned, on December 22, 2010, contacted Matthew Haeckler, Esquire, Assistant Counsel for Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles, who stated that Penn Dot has no interest in these matters other than the determination of who the owner of the vehicle is. 17. The undersigned caused a search of the records to be conducted by the Commonwealth of Pennsylvania, Department of Transportation, Bureau of Motor Vehicles (hereinafter, from time to time, simply referred to as "Penndot ") on January 22, 2014 in which the Bureau returned a finding that pursuant to the records of the Bureau the vehicle was last registered to Thomas B. Stolp, 200 Creekwood Drive, Camp Hill, Pennsylvania 17011 (The original Vehicle Record Abstract dated January 22, 2014 is attached hereto, made part hereof and marked as Exhibit "C "). 18.A search of the United States Department of Justice's National Motor Vehicle Title Information System (NMVTIS) was performed on January 22, 2014 and the search returned that the subject vehicle was found in the NMVTIS database as last registered in Pennsylvania. (A true and correct copy of the January 22, 2014 NMVTIS search results are attached hereto, made part hereof and marked as Exhibit "D "). 19.A search of the National Insurance Crime Bureau (NICB) VINCheck database was performed on January 22, 2014 and returned that the subject vehicle has not been identified as a vehicle listed in the VINCheck Theft Records or the VINCheck Total Loss Records. (A true and correct copy of January 22, 2014 NICB search results are attached hereto, made part hereof and marked as Exhibit "E "). 20. The failure to be able to forward a Certificate of Title to Penndot for processing does not operate to prevent the transfer of ownership of the vehicle herein. Dept. of Transp. v. Walker, 584 A.2d 1080 (Pa. Commw. Ct. 1990). 21. The primary function of certificates of title to automobiles have always been, and are still, to register the name and address of the person having the present right of possession, and to furnish persons dealing with one in possession of a car a means of determining whether such possession was prima facie lawful. Braham & Co. v. Steinard- Hannon Motor Co., 97 Pa. Super. 19, 23 (1929) See also Dept. of Transp. v. Walker at 1082. 22.The entering of a declaration of ownership in this case would serve to permit Trayer Rende to lawfully title, register and enjoy this automobile and would terminate and end any controversy or uncertainty of ownership which may come from having possession of or otherwise owning an untitled automobile. County of Cumberland I, Donald Wood, Sr., operate a towing, salvage and repair service at 555 Bosler Avenue, Lemoyne, Cumberland County, Pennsylvania, 17043, being duly sworn according to law, deposes and say that in approximately 2010 I was called by the police to tow a 2002 Chevrolet Corvette (VIN 1G1YY22G525131814) ("Corvette") that had been abandoned in a flood zone near the Harrisburg Area Community College (HACC) main campus in Harrisburg, Dauphin County, Pennsylvania. I towed the Corvette to my storage facility in Lemoyne. After a few days a lady, who identified herself as Brittany L. Gordy came to claim the Corvette. She stated that the car was hers, but she refused to pay the towing and storage fee and abandoned it on my lot. I further learned that the Corvette was last registered to Thomas B. Stolp of 200 Creekwood Drive, Camp Hill, Cumberland County, Pennsylvania 17011. I made a few attempts to contact Mr. Stolp but was informed that he had passed away. I made a few more attempts to contact Ms. Gordy however I could not locate her. From the time I towed the Corvette in approximately 2010 until present, no one other than Brittany L. Gordy came to claim the vehicle. I had the vehicle in my storage lot from 2010 through January 18, 2014 when I sold the Corvette to Trayer Rende for the unpaid storage fees and towing bill of $4,500.00. Mr. Rende paid me and I executed a bill of sale in favor him for the Corvette. I have agreed to make this affidavit in an effort to assist Mr. Rende with his petitioning of the Court for a title to the Corvette. I waive any right I may have to a hearing prior to an order being entered in this matter.
