COMPLAINT
I. The plaintiff is Wilsonart International, Inc. with place of business located at 11
Twosome Drive, Moorestown, New Jersey.
2. The defendant Ron Toomey who trades as Ron Toomey Fabrications with place of
business located at 904 16th Street, New Cumberland, Cumberland County, Pennsylvania.
3. At the instance and request of the defendant, the plaintiff sold and delivered to
defendant goods and merchandise at the times, of the kinds, in the quantities, for the prices and
pursuant to the terms set forth in plaintiff's invoices to defendant. A true and correct copy of the
open receivables is attached hereto, made a part hereof and are marked Exhibit A.
4. The goods and merchandise which plaintiff sold to the defendant were of a good and
merchantable quality and were those goods which the defendant had ordered from plaintiff The
defendant received and accepted all ofthe goods and merchandise sold to it by the plaintiff.
5. The prices plaintiff charged defendant were fair and reasonable and were the prices
defendant had agreed to pay plaintiff
6. From time to time, plaintiff sent to defendant statements reflecting a balance due
plaintiff in the sum of$7,664.98, which statements defendant received without protest.
7. Although demand was made by plaintiff upon defendant to pay the sum of$7,664.98,
the defendant failed and refused to pay all or any part thereof
8. Plaintiff is entitled to interest at 18% per annum if payment is not received by the lOth
of the month following the purchase of the merchandise pursuant to the application. A true and
correct copy ofthe application is attached, hereto marked Exhibit B and incorporated herein by
reference.
Wherefore, plaintiff Wilsonart International, Inc. demands judgment against defendant Ron
Toomey trading as Ron Toomey Fabrications in the sum $7,664.98 together with interest at 18%
per annum and the costs of this action.
