COMPLAINT IN MORTGAGE FORECLOSURE
1. Plaintiff is Nationstar Mortgage LLC d/b /a Champion Mortgage Company, duly
organized and doing business at the above - captioned address.
2. The Defendant is Unknown Surviving Heirs of John E. Foltz, Deceased Mortgagor
and Real Owner, and their last -known address is 102 East Main Street, Newburg, Pennsylvania
17240.
3. On November 20, 2008, John E. Foltz, mortgagor, made, executed and delivered a
mortgage upon the premises hereinafter described to Bank of America, N.A. which mortgage is
recorded in the Office of the Recorder of Cumberland County as Instrument Number 200930289
( "the Mortgage "), such Mortgage being incorporated herein by reference pursuant to Rule 1019(g)
Pa. R. C. P.
4. On November 20, 2008, John E. Foltz, also executed an Adjustable Rate Note
secured by the aforementioned mortgage. Plaintiff, directly or through an agent, is in possession of
the note and is the holder of the note with the right to enforce it; the note is either made payable to
plaintiff or has been duly endorsed.
5. On November 19, 2012, the Mortgage was assigned by Bank of America, N.A. to
Champion Mortgage Company, by Assignment of Mortgage, recorded in the Office of the Recorder
of Cumberland County as Instrument Number 201236494, such Assignment of Mortgage being
incorporated herein by reference pursuant to Rule 1019(g) Pa. R. C. P.
6. Nationstar Mortgage LLC is doing business as Champion Mortgage Company.
7. On October 25, 2013, John E. Foltz departed this life. No estate has been opened as a
result of the demise of John E. Foltz, Deceased Mortgagor and Real Owner.

8. The premises subject to said mortgage is described in the legal description attached as
Exhibit "A" and is known as 102 East Main Street, Newburg, Pennsylvania 17240.
9. By the terms of the Mortgage, all sums due and owing thereunder are now due and
payable by reason of the death of John E. Foltz, Deceased Mortgagor and Real Owner.
10. The following amounts are due on the mortgage:
Principal Balance $ 68,424.40
Interest through March 31, 2014 $ 2,079.95
plus per month interest thereafter which may adjust in
accordance with the terms of the note and mortgage
Attorney's Fee $ 1,650.00
Mortgage Insurance Premiums (MIP) $ 2,343.37
Service Fees $ 2,310.00
Insurance $ 427.00
Appraisals $ 840.00
Inspections $ 40.00
GRAND TOTAL $ 78,114.72
The attorney's fees set forth above are in conformity with the mortgage documents and Pennsylvania
law, and will be collected in the event of a third party purchaser at Sheriff s sale. If the mortgage is
reinstated prior to sale, reasonable and actually incurred attorney's fees will be charged in
accordance with the reduction provisions of Act 6, if applicable.
11.. Plaintiff complied with all notice requirements as prescribed by 41 P.S. § 101, et seq.
(Act 6), and 35 P.S. 1680.401c, et seq. (Act 91), as applicable.
12. Plaintiff does not hold the named Defendant personally liable on this cause of action
and releases them from any personal liability. This action is being brought to foreclose their interest
in the aforesaid real estate only.

WHEREFORE, Plaintiff demands in rem Judgment against the Defendant in the sum of
$78,1.14.72, together with interest per month thereafter which may adjust in accordance with the
terms of the note and mortgage, and other costs and charges collectible under the mortgage and for

NOTICE OF RESIDENTIAL MORTGAGE FORECLOSURE
DIVERSION PROGRAM
You have been served with a foreclosure complaint that could cause you to lose your home.
If you own and live in the residential property which is the subject of this foreclosure action, you may
be able to participate in a court- supervised conciliation conference in an effort to resolve this matter with your
lender.
If you do not have a lawyer, you must take the following steps to be eligible for a conciliation
conference. First, within twenty (20) days of your receipt of this notice, you must contact MidPenn Legal
Services at (717) 243 -9400 extension 2510 or (800) 822 -5288 extension 2510 and request appointment of a

promptly meet with that legal representative within twenty (20) days of the appointment date. During that
meeting, you must provide the legal representative with all requested financial information so that a loan
resolution proposal can be prepared on your behalf. If you and your legal representative complete a financial
worksheet in the format attached hereto, the legal representative will prepare and file a Request for Conciliation
Conference with the Court, which must be filed with the Court within sixty (60) days of the service upon you of
the foreclosure complaint. If you do so and a conciliation conference is scheduled, you will have an

Plaintiff, Nationstar Mortgage LLC d/b/a Champion Mortgage Company, by its counsel,
moves this Honorable Court for an Order directing service of the Complaint and of all subsequent

1 John E. Foltz was an individual and is the sole record owner and mortgagor of the
premises that is the subject of Plaintiff s action in Mortgage Foreclosure.
2. The premises that is subject of this mortgage foreclosure action is 102 East Main
Street, Newburg, Pennsylvania 17240 and is the last -known address of the decedent.
3 John E. Foltz is deceased, having departed this life on October 25, 2013. No estate
or administration has been opened as a result of the demise of John E. Foltz. As a result, Unknown
Surviving Heirs of John E. Foltz, Deceased Mortgagor and Real Owner have been named as
Defendants to this foreclosure action.
4. Plaintiff retained Attorney Outsourcing Support Services, Inc. to investigate the
identity of any additional heirs of John E. Foltz. No additional heirs were found. An Affidavit of
Good Faith Investigation setting forth the specific inquiries made and the results therefrom is
attached hereto, made a part hereof and marked as Exhibit "A."
5. Plaintiff has obtained a property search of the mortgage premises which indicates that
the record owner of the premises is John E. Foltz. A true and correct copy of the property search is
attached hereto and marked as Exhibit "B."
6. Plaintiff will never be able to personally serve the Complaint and subsequent
pleadings upon the Unknown Surviving Heirs of John E. Foltz, Deceased Mortgagor and Real
Owner.
7. Pursuant to Pennsylvania Rule of Civil Procedure 430(b)(2), service upon Unknown
Heirs may be made by publication.

pursuant to Pennsylvania Rules of Civil Procedure 430 and 3129.2(D) directing service of the

Notice of Sheriff's Sale by the Sheriff set forth in Pa.R.C.P 3129.2(D) is legally sufficient and

MEMORANDUM OF LAW
Attorneys for Plaintiff
Pennsylvania Rule of Civil Procedure 430(a) specifically provides:
(a) If service cannot be made under the applicable rule the Plaintiff may move the court
for a special order directing the method of service. The motion shall be accompanied by an Affidavit
stating the nature and extent of the investigation which has been made to determine the whereabouts
of the defendant and the reasons why service cannot be made.
Furthermore, Pennsylvania Rule of Civil Procedure 430(b)(2) specifically provides:
(2) When service is made by publication upon the heirs and assigns of a named former

owner or party in interest, the court may permit publication against the heirs or assigns generally if
it is set forth in the complaint or an affidavit that they are unknown.
Plaintiff has named , as Defendant in this action as known heir of John E. Foltz. However,
Plaintiff has been unable to identify and/or locate additional heirs of John E. Foltz.
WHEREFORE, Plaintiff respectfully requests this Honorable Court to enter an Order
pursuant to Pennsylvania Rules of Civil Procedure 430 and 3129.2(D) directing service of the
Complaint by posting, publication and by mail and further directing that all subsequent Notices and
pleadings that require personal service may be served in this manner except that publication of the
Notice of Sheriff's Sale by the Sheriff set forth in Pa.R.C.P 3129.2(D) is legally sufficient and
Plaintiff need not republish the Notice of Sheriff's Sale.

mortgaged premises of 102 East Main Street, Newburg, Pennsylvania 17240. A true and correct
copy of the Sheriff's Returns of Service indicating same is attached hereto, made a part hereof,
and marked as Exhibit "B".
4. That on June 28, 2014, in accordance with the attached Court Order, Plaintiff
served a true and correct copy of the Notice of the filing of the Complaint in Mortgage
Foreclosure upon the Defendant, Unknown Surviving Heirs of John E. Foltz, Deceased
Mortgagor and Real Owner, through publication in the The Sentinel. A true and correct copy of
the Proof of Publication indicating the same is attached hereto, made a part hereof, and marked

5. That on July 4, 2014, in accordance with the attached Court Order, Plaintiff
