WHEREAS, Mark A. Fahnestock and Kelly D. Fahnestock, of 4 Briarwood Court,
Mechanicsburg, PA 17050 is about to execute contemporaneously herewith, a contract, with
Fitzpatrick Construction , of Monroe Township, Cumberland County
, PA, for the erection of a single family dwelling upon a lot of land situate in the
Township of Monroe, Cumberland County , PA, (See Exhibit A).
Now, April 11th , 2014 at the time of and immediately before the execution of the
principal contract, and before any authority has been given by the said owner to the said contractor
to commence work on the said building, or purchase materials for the same in consideration of the
making of the said contract with and the further consideration of One Dollar, to paid by , it is
agreed that no lien shall be filed against the building by the contractor, or any sub - contractor. Nor
by any of the material men or workmen or any other person for any labor, or materials purchased,
or extra labor or materials purchased for the erection of said building, the right to file such liens
being expressly waived.

ALL THAT CERTAIN tract of land situate in Monroe Township, Cumberland County, Pennsylvania,
bounded and described according to the Final Subdivision Plan for Carol G. Knisely prepared by Eric L.
Diffenbaugh, P.L.S., dated May 20, 2004, revised through March 18, 2005, and recorded in Cumberland
County, Pennsylvania Plan Book 90, Page 100, as follows:
BEGINNING at a railroad spike set in the centerline of Lisburn Road, S.R. 2004, at the northwest corner
of Lot 4 as set forth on the above Plan; thence along said Lot 4, South 15 degrees 56 minutes 29 seconds
West 576.49 feet to an iron pin set; thence along land now or formerly of Edwin Z. Horst, South 77
degrees 00 minutes 00 seconds West 228.51 feet to an iron pin set; thence along Lot 5, North 15
degrees 56 minutes 29 seconds East 683.75 feet to a railroad spike set in the centerline of said Lisburn
Road; thence along the centerline of said Lisburn Road, South 75 degrees 00 minutes 33 seconds East
200.00 feet to a railroad spike, the point and place of Beginning.
BEING Lot 3 on the Final Subdivision Plan for Carol G. Knisely and containing 2.8927 gross acres.
